The cab\u00adi\u00adnet approved the draft on the same day. The reform is based on the coali\u00adtion agree\u00adment between the CDU and SPD and pur\u00adsues two clear\u00adly defined goals: Reduc\u00ading bureau\u00adcra\u00adcy through sig\u00adnif\u00adi\u00adcant\u00adly high\u00ader val\u00adue lim\u00adits on the one hand, and stricter com\u00adpli\u00adance with col\u00adlec\u00adtive agree\u00adments through new con\u00adtrol mech\u00ada\u00adnisms on the oth\u00ader. The explana\u00adto\u00adry mem\u00ado\u00adran\u00addum to the law states unequiv\u00ado\u00adcal\u00adly that the cur\u00adrent law from 2021 no longer meets the require\u00adments of a mod\u00adern state.   <\/p>\n\n<p class=\"wp-block-paragraph\">The bill was dis\u00adcussed in the first read\u00ading in the state par\u00adlia\u00adment. Many details will be reg\u00adu\u00adlat\u00aded by sub\u00adse\u00adquent ordi\u00adnances. <\/p>\n\n<h2 class=\"wp-block-heading\">Scope of appli\u00adca\u00adtion: New val\u00adue lim\u00adits<\/h2>\n\n<p class=\"wp-block-paragraph\">One of the most sig\u00adnif\u00adi\u00adcant changes con\u00adcerns the mate\u00adr\u00adi\u00adal scope of appli\u00adca\u00adtion. Pre\u00advi\u00adous\u00adly, the HVTG applied uni\u00adform\u00adly to all types of ser\u00advices above a con\u00adtract val\u00adue of EUR 10,000. In future, thresh\u00adolds spe\u00adcif\u00adic to the type of ser\u00advice will apply:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Sup\u00adplies and ser\u00advices: from 100,000 euros (net)<\/li>\n\n\n\n<li>Con\u00adstruc\u00adtion ser\u00advices: from 750,000 euros (net)<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">By way of dero\u00adga\u00adtion, a low\u00ader thresh\u00adold of EUR 20,000 (net) applies to col\u00adlec\u00adtive bar\u00adgain\u00ading and min\u00adi\u00admum wage oblig\u00ada\u00adtions as well as the new mon\u00adi\u00adtor\u00ading and sanc\u00adtion options. This reg\u00adu\u00adla\u00adtion also applies to legal enti\u00adties under pri\u00advate law with\u00adin the mean\u00ading of Sec\u00adtion 99 No. 2 GWB \u2014 i.e., for exam\u00adple, munic\u00adi\u00adpal util\u00adi\u00adty com\u00adpa\u00adnies, inso\u00adfar as they pro\u00adcure out\u00adside of their sec\u00adtor activ\u00adi\u00adty. <\/p>\n\n<h2 class=\"wp-block-heading\">Col\u00adlec\u00adtive bar\u00adgain\u00ading: Con\u00adsti\u00adtu\u00adtive oblig\u00ada\u00adtion instead of mere dec\u00adla\u00adra\u00adtion<\/h2>\n\n<p class=\"wp-block-paragraph\">The exist\u00ading col\u00adlec\u00adtive bar\u00adgain\u00ading regime will be tight\u00adened con\u00adsid\u00ader\u00adably. The HVTG 2026 autho\u00adrizes the respon\u00adsi\u00adble min\u00adistry to issue bind\u00ading sec\u00adtor-spe\u00adcif\u00adic min\u00adi\u00admum wages based on sec\u00adtoral col\u00adlec\u00adtive agree\u00adments by means of a statu\u00adto\u00adry order. These ordi\u00adnances are to be reviewed every two years to ensure they are up to date.  <\/p>\n\n<p class=\"wp-block-paragraph\">For areas in which no such ordi\u00adnance is issued, the pre\u00advi\u00adous col\u00adlec\u00adtive bar\u00adgain\u00ading regime con\u00adtin\u00adues to apply: con\u00adtrac\u00adtors must then at least ful\u00adfill the con\u00addi\u00adtions of the Min\u00adi\u00admum Wage Act and gen\u00ader\u00adal\u00adly bind\u00ading col\u00adlec\u00adtive agree\u00adments. The oblig\u00ada\u00adtion to com\u00adply with col\u00adlec\u00adtive agree\u00adments also express\u00adly extends to all sub\u00adcon\u00adtrac\u00adtors and rental com\u00adpa\u00adnies. <\/p>\n\n<h2 class=\"wp-block-heading\">New pre\u00adqual\u00adi\u00adfi\u00adca\u00adtion tar\u00adiff for con\u00adstruc\u00adtion ser\u00advices<\/h2>\n\n<p class=\"wp-block-paragraph\">A new instru\u00adment is the so-called pre\u00adqual\u00adi\u00adfi\u00adca\u00adtion tar\u00adiff (Sec\u00adtion 10 HVTG\u2011E). In future, bid\u00adders and appli\u00adcants will no longer have to prove their com\u00adpli\u00adance with the tar\u00adiff for con\u00adstruc\u00adtion ser\u00advices indi\u00advid\u00adu\u00adal\u00adly for each ten\u00adder, but rather by reg\u00adis\u00adter\u00ading in a pre\u00adqual\u00adi\u00adfi\u00adca\u00adtion list tar\u00adiff with the Vere\u00adin f\u00fcr Pr\u00e4qual\u00adi\u00adfika\u00adtion von Bau\u00adun\u00adternehmen e.V. (Asso\u00adci\u00ada\u00adtion for the Pre\u00adqual\u00adi\u00adfi\u00adca\u00adtion of Con\u00adstruc\u00adtion Com\u00adpa\u00adnies) or a com\u00adpa\u00adra\u00adble body. The reg\u00adis\u00adtra\u00adtion must not be old\u00ader than three years.  <\/p>\n\n<p class=\"wp-block-paragraph\">The pre\u00adqual\u00adi\u00adfi\u00adca\u00adtion tar\u00adiff is inde\u00adpen\u00addent of the exist\u00ading suit\u00adabil\u00adi\u00adty pre\u00adqual\u00adi\u00adfi\u00adca\u00adtion pro\u00adce\u00addure and must be com\u00adplet\u00aded sep\u00ada\u00adrate\u00adly by each poten\u00adtial bid\u00adder. Proof must already be pro\u00advid\u00aded when sub\u00admit\u00adting a request to par\u00adtic\u00adi\u00adpate or when sub\u00admit\u00adting a ten\u00adder. <\/p>\n\n<p class=\"wp-block-paragraph\">The dec\u00adla\u00adra\u00adtion of com\u00admit\u00adment in text form remains valid for the award\u00ading of sup\u00adply and ser\u00advice con\u00adtracts.<\/p>\n\n<p class=\"wp-block-paragraph\">This does not apply to work\u00adshops for peo\u00adple with dis\u00adabil\u00adi\u00adties, inclu\u00adsive busi\u00adness\u00ades, rec\u00adog\u00adnized work\u00adshops for the blind and pris\u00adons \u2014 they are auto\u00admat\u00adi\u00adcal\u00adly pre\u00adqual\u00adi\u00adfied.<\/p>\n\n<p class=\"wp-block-paragraph\">A tran\u00adsi\u00adtion\u00adal peri\u00adod applies for the first six months after entry into force: dur\u00ading this time, the oblig\u00ada\u00adtion to com\u00adply with col\u00adlec\u00adtive agree\u00adments for con\u00adstruc\u00adtion ser\u00advices can still be ful\u00adfilled alter\u00adna\u00adtive\u00adly by means of a dec\u00adla\u00adra\u00adtion of com\u00admit\u00adment or pre\u00adqual\u00adi\u00adfi\u00adca\u00adtion that has already been com\u00adplet\u00aded.<\/p>\n\n<h2 class=\"wp-block-heading\">Pro\u00adcure\u00adment pro\u00adce\u00addures: More flex\u00adi\u00adbil\u00adi\u00adty below the EU thresh\u00adolds<\/h2>\n\n<p class=\"wp-block-paragraph\">Pre\u00advi\u00adous\u00adly, the choice of award pro\u00adce\u00addure in the HVTG was linked to cer\u00adtain con\u00adtract val\u00adue cor\u00adri\u00addors. This oblig\u00ada\u00adtion will no longer apply in future. Below the EU thresh\u00adolds, pub\u00adlic con\u00adtract\u00ading author\u00adi\u00adties can choose between the stan\u00addard pro\u00adce\u00addures (pub\u00adlic invi\u00adta\u00adtion to ten\u00adder, restrict\u00aded invi\u00adta\u00adtion to ten\u00adder with a call for com\u00adpe\u00adti\u00adtion), restrict\u00aded invi\u00adta\u00adtion to ten\u00adder with\u00adout a call for com\u00adpe\u00adti\u00adtion, direct award and nego\u00adti\u00adat\u00aded award. The spe\u00adcif\u00adic scope of the com\u00adpe\u00adti\u00adtion to be estab\u00adlished is still based on the UVgO and the VOB\/A in the ver\u00adsion applic\u00ada\u00adble in Hesse.   <\/p>\n\n<h2 class=\"wp-block-heading\">Best bid\u00adder prin\u00adci\u00adple<\/h2>\n\n<p class=\"wp-block-paragraph\">The best bid\u00adder prin\u00adci\u00adple is new\u00adly intro\u00adduced (Sec\u00adtion 16 HVTG\u2011E). In future, manda\u00adto\u00adry dec\u00adla\u00adra\u00adtions and evi\u00addence \u2014 with the excep\u00adtion of tar\u00adiff pre\u00adqual\u00adi\u00adfi\u00adca\u00adtion and dec\u00adla\u00adra\u00adtions of com\u00admit\u00adment \u2014 must only be request\u00aded from the poten\u00adtial suc\u00adcess\u00adful bid\u00adder. The con\u00adtract\u00ading author\u00adi\u00adty sets a dead\u00adline of up to sev\u00aden cal\u00aden\u00addar days for this. If the doc\u00adu\u00adments are not received by the dead\u00adline, the ten\u00adder will be exclud\u00aded and the next high\u00adest ranked bid\u00adder will be invit\u00aded.   <\/p>\n\n<p class=\"wp-block-paragraph\">If bid\u00adders already sub\u00admit the doc\u00adu\u00adments with the bid, this does not lead to exclu\u00adsion.<\/p>\n\n<h2 class=\"wp-block-heading\">Sub\u00adcon\u00adtrac\u00adtor chain: Max\u00adi\u00admum of three links<\/h2>\n\n<p class=\"wp-block-paragraph\">\u00a7 Sec\u00adtion 5 HVTG\u2011E lim\u00adits the sub\u00adcon\u00adtrac\u00adtor chain to three links for the first time: com\u00admis\u00adsioned com\u00adpa\u00adny \u2014 sub\u00adcon\u00adtrac\u00adtor 1 \u2014 sub\u00adcon\u00adtrac\u00adtor 2. This is not about the num\u00adber of sub\u00adcon\u00adtrac\u00adtors used in par\u00adal\u00adlel, but about the depth of the chain: the sec\u00adond sub\u00adcon\u00adtrac\u00adtor is the last link that may pass on the same sub\u00adject mat\u00adter.<\/p>\n\n<p class=\"wp-block-paragraph\">The con\u00adtract\u00aded com\u00adpa\u00adny must also obtain the pri\u00ador con\u00adsent of the con\u00adtract\u00ading author\u00adi\u00adty for each use of a sub\u00adcon\u00adtrac\u00adtor or rental com\u00adpa\u00adny.<\/p>\n\n<h2 class=\"wp-block-heading\">Con\u00adtrols and sanc\u00adtions<\/h2>\n\n<p class=\"wp-block-paragraph\">The law has been giv\u00aden a new sixth part with com\u00adpre\u00adhen\u00adsive con\u00adtrol pow\u00aders. From the start of con\u00adtract per\u00adfor\u00admance, con\u00adtract\u00ading author\u00adi\u00adties are enti\u00adtled to enter con\u00adstruc\u00adtion sites, facil\u00adi\u00adties and oper\u00adat\u00ading sites of the con\u00adtract\u00aded com\u00adpa\u00adnies and their sub\u00adcon\u00adtrac\u00adtors, even unan\u00adnounced, to inspect proof of iden\u00adti\u00adty and to ques\u00adtion employ\u00adees about their employ\u00adment rela\u00adtion\u00adship. <\/p>\n\n<p class=\"wp-block-paragraph\">A new\u00adly estab\u00adlished con\u00adtrol group at the respon\u00adsi\u00adble min\u00adistry sup\u00adports the clients in these con\u00adtrols on request.<\/p>\n\n<p class=\"wp-block-paragraph\">The law pro\u00advides for the fol\u00adlow\u00ading sanc\u00adtions in the event of vio\u00adla\u00adtions:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Con\u00adtrac\u00adtu\u00adal penal\u00adty of up to 5% of the invoiced amount (net) per cul\u00adpa\u00adble breach; the total amount of all con\u00adtrac\u00adtu\u00adal penal\u00adties is lim\u00adit\u00aded to 10% of the invoiced amount<\/li>\n\n\n\n<li>Right to ter\u00admi\u00adnate with\u00adout notice in the case of con\u00adtin\u00adu\u00ading oblig\u00ada\u00adtions<\/li>\n\n\n\n<li>Exclu\u00adsion from award\u00ading con\u00adtracts for up to three years by the con\u00adtract\u00ading author\u00adi\u00adty con\u00adcerned<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Dis\u00adcon\u00adtin\u00adu\u00ada\u00adtion of the Frank\u00adfurt infor\u00adma\u00adtion cen\u00adter<\/h2>\n\n<p class=\"wp-block-paragraph\">The pre\u00advi\u00adous infor\u00adma\u00adtion office at the Frank\u00adfurt am Main Region\u00adal Finance Direc\u00adtorate will no longer exist. The pos\u00adsi\u00adbil\u00adi\u00adty of object\u00ading to breach\u00ades of pro\u00adcure\u00adment reg\u00adu\u00adla\u00adtions before the com\u00adpe\u00adtent author\u00adi\u00adties will be retained \u2014 but only for awards with an esti\u00admat\u00aded con\u00adtract val\u00adue of more than 750,000 euros for con\u00adstruc\u00adtion ser\u00advices and more than 100,000 euros for sup\u00adplies and ser\u00advices. <\/p>\n\n<h2 class=\"wp-block-heading\">Entry into force<\/h2>\n\n<p class=\"wp-block-paragraph\">The law comes into force on the day after its pro\u00admul\u00adga\u00adtion.
