The Fed\u00ader\u00adal Col\u00adlec\u00adtive Bar\u00adgain\u00ading Act (BTTG)<\/a> has been passed. On March 27, 2026, the Fed\u00ader\u00adal Coun\u00adcil approved the law in its 1063rd ses\u00adsion. This con\u00adcludes the par\u00adlia\u00admen\u00adtary pro\u00adce\u00addure: The law can now be drawn up and pro\u00admul\u00adgat\u00aded and will enter into force for the most part on the day after pro\u00admul\u00adga\u00adtion. <\/p>\n\n

We had already pre\u00adsent\u00aded the project in detail on the occa\u00adsion of the Bun\u00addestag res\u00ado\u00adlu\u00adtion of Feb\u00adru\u00adary 26, 2026. With the approval of the Bun\u00addesrat, the ques\u00adtion now aris\u00ades as to what specif\u00adi\u00adcal\u00adly applies \u2014 and what clients and com\u00adpa\u00adnies need to pre\u00adpare imme\u00addi\u00adate\u00adly. <\/p>\n\n

Back\u00adground: Why the law?<\/h2>\n\n

Col\u00adlec\u00adtive bar\u00adgain\u00ading cov\u00ader\u00adage in Ger\u00admany has declined con\u00adsid\u00ader\u00adably in recent decades: Where\u00adas around three out of four work\u00adplaces used to be cov\u00adered by col\u00adlec\u00adtive agree\u00adments, this now only applies to one in two. Com\u00adpa\u00adnies with\u00adout col\u00adlec\u00adtive bar\u00adgain\u00ading cov\u00ader\u00adage have been able to sub\u00admit more favor\u00adable bids in the com\u00adpe\u00adti\u00adtion for pub\u00adlic con\u00adtracts because they have low\u00ader per\u00adson\u00adnel costs. The BTTG is intend\u00aded to elim\u00adi\u00adnate this com\u00adpet\u00adi\u00adtive dis\u00adad\u00advan\u00adtage for com\u00adpa\u00adnies bound by col\u00adlec\u00adtive agree\u00adments and cre\u00adate an incen\u00adtive for col\u00adlec\u00adtive bar\u00adgain\u00ading \u2014 financed with tax\u00adpay\u00aders\u2019 mon\u00adey, wage dump\u00ading should no longer be pos\u00adsi\u00adble in future. <\/p>\n\n

Added to this is the polit\u00adi\u00adcal tim\u00ading: the spe\u00adcial infra\u00adstruc\u00adture fund will be used to award numer\u00adous pub\u00adlic con\u00adtracts in the com\u00ading years \u2014 for bridges, hos\u00adpi\u00adtals and school build\u00adings. The fed\u00ader\u00adal gov\u00adern\u00adment is thus send\u00ading a clear sig\u00adnal as to the con\u00addi\u00adtions under which these funds will flow into the mar\u00adket. <\/p>\n\n

Scope of appli\u00adca\u00adtion: To whom does the BTTG apply?<\/h2>\n\n

The law applies at fed\u00ader\u00adal lev\u00adel to con\u00adstruc\u00adtion and ser\u00advice con\u00adtracts. It does not apply to sup\u00adply con\u00adtracts. All Bun\u00addeswehr con\u00adtracts are also com\u00adplete\u00adly exempt. <\/p>\n\n

The thresh\u00adold val\u00adues at a glance:<\/p>\n\n

  • Stan\u00addard case: Con\u00adstruc\u00adtion and ser\u00advices with an esti\u00admat\u00aded con\u00adtract val\u00adue of 50,000 euros or more<\/li>\n\n\n\n

    The law there\u00adfore only applies to pro\u00adcure\u00adment at fed\u00ader\u00adal lev\u00adel. Sev\u00ader\u00adal fed\u00ader\u00adal states already have their own col\u00adlec\u00adtive bar\u00adgain\u00ading laws \u2014 these remain unaf\u00adfect\u00aded, but do not apply to fed\u00ader\u00adal con\u00adtract\u00ading author\u00adi\u00adties. <\/p>\n\n

    The promise to com\u00adply with col\u00adlec\u00adtive agree\u00adments: What do con\u00adtrac\u00adtors have to ful\u00adfill?<\/h2>\n\n

    The core of the law is not an auto\u00admat\u00adic com\u00admit\u00adment to col\u00adlec\u00adtive bar\u00adgain\u00ading. Con\u00adtrac\u00adtors must make a promise to adhere to col\u00adlec\u00adtive bar\u00adgain\u00ading agree\u00adments: They under\u00adtake to grant the employ\u00adees deployed in the exe\u00adcu\u00adtion of the con\u00adtract cer\u00adtain min\u00adi\u00admum work\u00ading con\u00addi\u00adtions in accor\u00addance with col\u00adlec\u00adtive bar\u00adgain\u00ading agree\u00adments. This promise is includ\u00aded in the con\u00adtract as a manda\u00adto\u00adry per\u00adfor\u00admance con\u00addi\u00adtion. <\/p>\n\n

    The Fed\u00ader\u00adal Min\u00adistry of Labor and Social Affairs (BMAS) deter\u00admines the spe\u00adcif\u00adic con\u00addi\u00adtions to be com\u00adplied with by sec\u00adtor-spe\u00adcif\u00adic statu\u00adto\u00adry order \u2014 at the request of one or both par\u00adties to the col\u00adlec\u00adtive agree\u00adment. At least the fol\u00adlow\u00ading are reg\u00adu\u00adlat\u00aded: <\/p>\n\n

    • Paid min\u00adi\u00admum annu\u00adal leave<\/li>\n\n\n\n
    • Max\u00adi\u00admum work\u00ading hours<\/li>\n\n\n\n
    • Min\u00adi\u00admum rest peri\u00adods and rest breaks<\/li>\n<\/ul>\n\n

      The promise to com\u00adply with col\u00adlec\u00adtive agree\u00adments can be made sim\u00adply and unbu\u00adreau\u00adcrat\u00adi\u00adcal\u00adly dur\u00ading the award pro\u00adce\u00addure. Bureau\u00adcra\u00adcy, ver\u00adi\u00adfi\u00adca\u00adtion require\u00adments and con\u00adtrols should be kept to a min\u00adi\u00admum in accor\u00addance with the declared aim of the leg\u00adis\u00adla\u00adtor. <\/p>\n\n

      Oblig\u00ada\u00adtion to pro\u00advide evi\u00addence and dis\u00adclo\u00adsure to sub\u00adcon\u00adtrac\u00adtors<\/h2>\n\n

      Con\u00adtrac\u00adtors can obtain cer\u00adti\u00adfi\u00adca\u00adtion that they meet the require\u00adments of the col\u00adlec\u00adtive agree\u00adment. If this is not pos\u00adsi\u00adble, com\u00adpre\u00adhen\u00adsi\u00adble doc\u00adu\u00admen\u00adta\u00adtion must be ensured \u2014 clean pay slips, pre\u00adsen\u00adta\u00adtions of struc\u00adtur\u00adal allowances, work records. The rel\u00ade\u00advant doc\u00adu\u00adments must be sub\u00admit\u00adted via the pen\u00adsion insur\u00adance sys\u00adtem. <\/p>\n\n

      Impor\u00adtant: The oblig\u00ada\u00adtion to com\u00adply with col\u00adlec\u00adtive agree\u00adments must be passed on to sub\u00adcon\u00adtrac\u00adtors and hir\u00aders. The con\u00adtrac\u00adtor is liable for ensur\u00ading that the require\u00adments are also met at all fur\u00adther stages of ser\u00advice pro\u00advi\u00adsion. Con\u00adtract chains and doc\u00adu\u00admen\u00adta\u00adtion process\u00ades should be set up accord\u00ading\u00adly. <\/p>\n\n

      New author\u00adi\u00adty: Fed\u00ader\u00adal Col\u00adlec\u00adtive Agree\u00adment Ver\u00adi\u00adfi\u00adca\u00adtion Body<\/h2>\n\n

      The BTTG cre\u00adates a new author\u00adi\u00adty: the Fed\u00ader\u00adal Tar\u00adiff Com\u00adpli\u00adance Check\u00adpoint. It mon\u00adi\u00adtors com\u00adpli\u00adance with the oblig\u00ada\u00adtions under the Act and iden\u00adti\u00adfies infringe\u00adments by admin\u00adis\u00adtra\u00adtive act. Final admin\u00adis\u00adtra\u00adtive acts are for\u00adward\u00aded to the reg\u00adis\u00adter author\u00adi\u00adty of the com\u00adpe\u00adti\u00adtion reg\u00adis\u00adter (Fed\u00ader\u00adal Car\u00adtel Office) and can lead to reg\u00adis\u00adtra\u00adtion there. <\/p>\n\n

      The Enforce\u00adment Pan\u00adel is autho\u00adrized to request pay data from Deutsche Renten\u00adver\u00adsicherung Knapp\u00adschaft-Bahn-See. Checks are car\u00adried out on an ad hoc basis; ran\u00addom checks are not planned. <\/p>\n\n

      Sanc\u00adtions: Con\u00adtrac\u00adtu\u00adal penal\u00adty, ter\u00admi\u00adna\u00adtion, exclu\u00adsion<\/h2>\n\n

      The BTTG pro\u00advides for a dif\u00adfer\u00aden\u00adti\u00adat\u00aded sys\u00adtem of sanc\u00adtions:<\/p>\n\n

      • Con\u00adtrac\u00adtu\u00adal penal\u00adty reg\u00adu\u00adla\u00adtion: The con\u00adtrac\u00adtu\u00adal penal\u00adty amounts to a max\u00adi\u00admum of 1% of the con\u00adtract val\u00adue per vio\u00adla\u00adtion and a max\u00adi\u00admum total of 10% of the con\u00adtract val\u00adue. It is for\u00adfeit\u00aded as soon as a vio\u00adla\u00adtion has been deter\u00admined by the Fed\u00ader\u00adal Office for Har\u00admo\u00adniza\u00adtion of Tar\u00adiffs by admin\u00adis\u00adtra\u00adtive act. <\/li>\n\n\n\n
      • Extra\u00ador\u00addi\u00adnary right of ter\u00admi\u00adna\u00adtion: The client can ter\u00admi\u00adnate the con\u00adtract extra\u00ador\u00addi\u00adnar\u00adi\u00adly if the con\u00adtrac\u00adtu\u00adal penal\u00adty is for\u00adfeit\u00aded.<\/li>\n\n\n\n
      • Option\u00adal rea\u00adson for exclu\u00adsion in accor\u00addance with Sec\u00adtion 14 BTTG: Con\u00adtract\u00ading author\u00adi\u00adties should exclude a com\u00adpa\u00adny from par\u00adtic\u00adi\u00adpat\u00ading in award pro\u00adce\u00addures if a breach of col\u00adlec\u00adtive bar\u00adgain\u00ading oblig\u00ada\u00adtions has been incon\u00adtestably estab\u00adlished. This rea\u00adson for exclu\u00adsion applies irre\u00adspec\u00adtive of the con\u00adtract val\u00adue. The self-clean\u00ading pro\u00adce\u00addure pur\u00adsuant to Sec\u00adtion 125 GWB is applic\u00ada\u00adble. <\/li>\n<\/ul>\n\n
