The eval\u00adu\u00ada\u00adtion pro\u00advid\u00aded for a weight\u00ading of 40 % price and 60 % qual\u00adi\u00adty (project-spe\u00adcif\u00adic solu\u00adtion approach).   <\/p>\n\n<p class=\"wp-block-paragraph\">The for\u00admu\u00adla defined for the qual\u00adi\u00adty cri\u00adte\u00adri\u00adon was par\u00adtic\u00adu\u00adlar\u00adly con\u00adtro\u00adver\u00adsial: the bid\u00adder with the high\u00adest score was to receive the full 5 points, while the bid\u00adder with the low\u00adest score was to auto\u00admat\u00adi\u00adcal\u00adly receive 0 points. As there were ulti\u00admate\u00adly only two bids eli\u00adgi\u00adble for eval\u00adu\u00ada\u00adtion, this meant that the appli\u00adcan\u00adt\u2019s bid, which was slight\u00adly weak\u00ader in terms of qual\u00adi\u00adty (but low\u00ader in price), was left com\u00adplete\u00adly emp\u00adty-hand\u00aded in the per\u00adfor\u00admance cri\u00adte\u00adri\u00adon. Despite hav\u00ading the best price, it had no chance of being award\u00aded the con\u00adtract due to the \u201czero-point rat\u00ading\u201d in terms of qual\u00adi\u00adty.    <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Key point of the deci\u00adsion<\/strong> <\/h2>\n\n<p class=\"wp-block-paragraph\">The OLG D\u00fcs\u00adsel\u00addorf clar\u00adi\u00adfied that such an \u201call-or-noth\u00ading prin\u00adci\u00adple\u201d exceeds the clien\u00adt\u2019s broad scope of judg\u00adment. This ille\u00adgal\u00adi\u00adty applies not only in the case of two bid\u00adders, but gen\u00ader\u00adal\u00adly when\u00adev\u00ader the eval\u00adu\u00ada\u00adtion sys\u00adtem ignores the actu\u00adal points dif\u00adfer\u00adence between the bids and penal\u00adizes the worst bid with zero points regard\u00adless of its rel\u00ada\u00adtive qual\u00adi\u00adty. Despite this deci\u00adsion, the admis\u00adsi\u00adbil\u00adi\u00adty of zero points remains under cer\u00adtain con\u00addi\u00adtions. The court empha\u00adsized that zero-point scores are not inad\u00admis\u00adsi\u00adble per se. How\u00adev\u00ader, they must be linked to an objec\u00adtive stan\u00addard, as is usu\u00adal in price eval\u00adu\u00ada\u00adtion, for exam\u00adple, where only dou\u00adble the low\u00adest price leads to zero points, instead of mere\u00adly being based on the rank\u00ading of the bid\u00adders.    <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Tips for pub\u00adlic clients<\/strong> <\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Check inter\u00adpo\u00adla\u00adtion:<\/strong> Make sure your scor\u00ading method\u00adol\u00ado\u00adgy reflects the actu\u00adal per\u00adfor\u00admance gap. A lin\u00adear gap between first and last place with\u00adout look\u00ading at the points dif\u00adfer\u00adence is risky. <\/li>\n\n\n\n<li><strong>Set fixed ref\u00ader\u00adence points:<\/strong> Define a fac\u00adtu\u00adal anchor point for the award of zero points (e.g. min\u00adi\u00admum require\u00adments or a fic\u00adti\u00adtious com\u00adpar\u00ada\u00adtive offer) instead of penal\u00adiz\u00ading the worst bid\u00adder in the field across the board.<\/li>\n\n\n\n<li><strong>Sharp\u00aden doc\u00adu\u00admen\u00adta\u00adtion:<\/strong> Jus\u00adti\u00adfy qual\u00adi\u00adta\u00adtive dif\u00adfer\u00adences in detail in order to be able to demon\u00adstrate that the rank\u00ading is essen\u00adtial\u00adly based on fac\u00adtu\u00adal con\u00adsid\u00ader\u00ada\u00adtions, even in the event of method\u00adolog\u00adi\u00adcal errors in the sys\u00adtem.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Tips for bid\u00adders and fund\u00ading recip\u00adi\u00adents<\/strong> <\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Report the method\u00adol\u00ado\u00adgy at an ear\u00adly stage:<\/strong> If you rec\u00adog\u00adnize an \u201call-or-noth\u00ading sys\u00adtem\u201d in the ten\u00adder doc\u00adu\u00adments that dis\u00adtorts com\u00adpe\u00adti\u00adtion, com\u00adplain about this at an ear\u00adly stage in order to pro\u00adtect your rights.<\/li>\n\n\n\n<li><strong>Be care\u00adful with the imme\u00addi\u00adate appeal: <\/strong>In the event of court pro\u00adceed\u00adings, make absolute\u00adly sure to explic\u00adit\u00adly apply for an exten\u00adsion of the pro\u00adhi\u00adbi\u00adtion on sur\u00adcharg\u00ading. A mere attack on the deci\u00adsion is not suf\u00adfi\u00adcient to pre\u00advent the award dur\u00ading the pro\u00adceed\u00adings. <\/li>\n\n\n\n<li><strong>Qual\u00adi\u00adty instead of stan\u00addard: <\/strong>Don\u2019t rely on a low price alone.
