A recent deci\u00adsion by the Schleswig-Hol\u00adstein Cham\u00adber of Pub\u00adlic Pro\u00adcure\u00adment dat\u00aded Sep\u00adtem\u00adber 29, 2023 (AZ VK-SH 11\/23) under\u00adlines the impor\u00adtance of trans\u00adpar\u00adent pric\u00ading spec\u00adi\u00adfi\u00adca\u00adtions when award\u00ading school trans\u00adport ser\u00advices. In addi\u00adtion to the main jour\u00adneys between school and home, spe\u00adcial jour\u00adneys were also put out to ten\u00adder. The aim was to deter\u00admine the most eco\u00adnom\u00adi\u00adcal offer based on an eval\u00adu\u00ada\u00adtion price, 50% of which con\u00adsist\u00aded of cal\u00adcu\u00adlat\u00aded total kilo\u00adme\u00adters. This cal\u00adcu\u00adla\u00adtion was based on unspec\u00adi\u00adfied empir\u00adi\u00adcal val\u00adues that were not dis\u00adclosed in the ten\u00adder doc\u00adu\u00adments. The remain\u00ading part of the eval\u00adu\u00ada\u00adtion was based on the price per occu\u00adpied kilo\u00adme\u00adter.    <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>The con\u00adflict<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">The award led to dis\u00adputes: An unsuc\u00adcess\u00adful bid\u00adder lodged a com\u00adplaint and object\u00aded in par\u00adtic\u00adu\u00adlar to the ade\u00adqua\u00adcy check in accor\u00addance with Sec\u00adtion 60 VgV, which it con\u00adsid\u00adered to be inad\u00ade\u00adquate. The pro\u00adcure\u00adment cham\u00adber ini\u00adtial\u00adly agreed and request\u00aded the con\u00adtract\u00ading author\u00adi\u00adty to car\u00adry out the price check. The con\u00adtract\u00ading author\u00adi\u00adty car\u00adried out the clar\u00adi\u00adfi\u00adca\u00adtion and adhered to its orig\u00adi\u00adnal deci\u00adsion. The unsuc\u00adcess\u00adful bid\u00adder chal\u00adlenged this again.   <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Pro\u00adceed\u00adings before the pro\u00adcure\u00adment cham\u00adber<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">The award\u00ading cham\u00adber exam\u00adined in detail whether the price clar\u00adi\u00adfi\u00adca\u00adtion was car\u00adried out prop\u00ader\u00adly. The mea\u00adsures tak\u00aden by the con\u00adtract\u00ading author\u00adi\u00adty includ\u00aded <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Review of vehi\u00adcle and per\u00adson\u00adnel costs<\/li>\n\n\n\n<li>Analy\u00adsis of cal\u00adcu\u00adla\u00adtion bases, such as min\u00adi\u00admum wage and oper\u00adat\u00ading costs<\/li>\n\n\n\n<li>Mul\u00adti\u00adple queries to the bid\u00adder to con\u00adcretize its cal\u00adcu\u00adla\u00adtion<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n<p class=\"wp-block-paragraph\">The award\u00ading cham\u00adber assessed these steps pos\u00adi\u00adtive\u00adly and con\u00adsid\u00adered the price clar\u00adi\u00adfi\u00adca\u00adtion to be suf\u00adfi\u00adcient.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Assess\u00adment by the OLG Schleswig-Hol\u00adstein<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">The High\u00ader Region\u00adal Court of Schleswig found that the pric\u00ading spec\u00adi\u00adfi\u00adca\u00adtions were pos\u00adsi\u00adbly non-trans\u00adpar\u00adent. It was par\u00adtic\u00adu\u00adlar\u00adly crit\u00adi\u00adcal of the dif\u00adfer\u00adence between the val\u00adu\u00ada\u00adtion price and the tour price actu\u00adal\u00adly invoiced. If this lack of trans\u00adparen\u00adcy is con\u00adfirmed, the entire pro\u00adce\u00addure could be flawed.  <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Access to files and pro\u00adtec\u00adtion of secrets<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">Anoth\u00ader point of dis\u00adpute con\u00adcerned access to the suc\u00adcess\u00adful bid\u00adder\u2019s files. The OLG ruled that com\u00adpre\u00adhen\u00adsive dis\u00adclo\u00adsures were not per\u00admis\u00adsi\u00adble for rea\u00adsons of trade secret pro\u00adtec\u00adtion. Instead, the Sen\u00adate con\u00adduct\u00aded its own exam\u00adi\u00adna\u00adtion.  <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Con\u00adclu\u00adsion<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The deci\u00adsion shows how sen\u00adsi\u00adtive\u00adly and com\u00adplex\u00adly ten\u00adders must be designed in order to meet both legal and eco\u00adnom\u00adic require\u00adments.
