{"id":23385,"date":"2025-08-22T10:54:00","date_gmt":"2025-08-22T08:54:00","guid":{"rendered":"https:\/\/abante.de\/award-according-to-konzvgv-and-vgv-possible-despite-area-exception\/"},"modified":"2026-02-19T11:33:40","modified_gmt":"2026-02-19T10:33:40","slug":"award-according-to-konzvgv-and-vgv-possible-despite-area-exception","status":"publish","type":"post","link":"https:\/\/abante.de\/en\/award-according-to-konzvgv-and-vgv-possible-despite-area-exception\/","title":{"rendered":"Award accord\u00ading to KonzVgV and VgV pos\u00adsi\u00adble despite area excep\u00adtion!"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">On August 22, 2025, our lawyer Daniel Sch\u00f6lzel dealt with the deci\u00adsion of the Darm\u00adstadt Admin\u00adis\u00adtra\u00adtive Court of April 1, 2025 (Ref.: 7 L 2856\/24) in a LinkedIn live on pub\u00adlic pro\u00adcure\u00adment law.  <\/p>\n\n<p class=\"wp-block-paragraph\">On April 1, 2025, the Darm\u00adstadt Admin\u00adis\u00adtra\u00adtive Court ruled in its deci\u00adsion (case ref\u00ader\u00adence: 7 L 2856\/24) that a selec\u00adtion pro\u00adce\u00addure for the award of ser\u00advice con\u00adces\u00adsions or con\u00adtracts may be car\u00adried out in the con\u00adtext of sub\u00adsi\u00addized broad\u00adband projects in accor\u00addance with the antitrust pro\u00advi\u00adsions of the KonzVgV and VgV \u2014 even if a sec\u00adtor excep\u00adtion actu\u00adal\u00adly applies.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Our video dis\u00adcussing the judg\u00adment:<\/strong><\/p>\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe hcb-fetch-image-from=\"https:\/\/youtu.be\/iSztk3ilUhI\" title=\"Konzessionsverfahren nach KonzVgV\/VgV trotz Bereichsausnahme m\u00f6glich!\" width=\"800\" height=\"450\" src=\"https:\/\/www.youtube.com\/embed\/iSztk3ilUhI?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n<h2 class=\"wp-block-heading\"><strong>Facts of the case<\/strong> <\/h2>\n\n<p class=\"wp-block-paragraph\">The defen\u00addant (AG) \u2014 a munic\u00adi\u00adpal\u00adi\u00adty \u2014 received grants for a prof\u00aditabil\u00adi\u00adty gap mod\u00adel from both the fed\u00ader\u00adal and state fund\u00ading bod\u00adies for broad\u00adband expan\u00adsion as part of the so-called white-spot pro\u00adgram. Both under\u00adly\u00ading fund\u00ading deci\u00adsions express\u00adly referred to the NGA frame\u00adwork reg\u00adu\u00adla\u00adtion and the Broad\u00adband Direc\u00adtive.   <\/p>\n\n<p class=\"wp-block-paragraph\">To imple\u00adment the project, the GTC invit\u00aded ten\u00adders for con\u00adstruc\u00adtion and net\u00adwork oper\u00ada\u00adtion ser\u00advices in a Europe-wide selec\u00adtion pro\u00adce\u00addure. The ten\u00adder doc\u00adu\u00adments used there con\u00adtained the gen\u00ader\u00adal infor\u00adma\u00adtion that the pro\u00adce\u00addure would be car\u00adried out in accor\u00addance with the pro\u00advi\u00adsions of the Con\u00adces\u00adsion Award Ordi\u00adnance (KonzVgV) and the Pub\u00adlic Pro\u00adcure\u00adment Ordi\u00adnance (VgV). How\u00adev\u00ader, indi\u00advid\u00adual pro\u00advi\u00adsions of the afore\u00admen\u00adtioned reg\u00adu\u00adla\u00adtions were not list\u00aded.    <\/p>\n\n<p class=\"wp-block-paragraph\">The appli\u00adcant (ASt) \u2014 a bid\u00adder in the pro\u00adceed\u00adings \u2014 sub\u00admit\u00adted a bid that was sub\u00adject\u00aded to a price clar\u00adi\u00adfi\u00adca\u00adtion. This was due to the fol\u00adlow\u00ading anom\u00adalies: On the one hand, inad\u00admis\u00adsi\u00adble mixed cal\u00adcu\u00adla\u00adtions were made, on the oth\u00ader hand, the prices were set unusu\u00adal\u00adly low. As ASt was unable to dis\u00adpel the doubts about the ade\u00adqua\u00adcy of the prices, its bid was exclud\u00aded. It applied to the Darm\u00adstadt Admin\u00adis\u00adtra\u00adtive Court (VG) for inter\u00adim legal pro\u00adtec\u00adtion against the impend\u00ading award of the con\u00adtract to a com\u00adpeti\u00adtor.  <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Key point of the deci\u00adsion<\/strong> <\/h2>\n\n<p class=\"wp-block-paragraph\">The VG Darm\u00adstadt clar\u00adi\u00adfied: Even if con\u00adces\u00adsions for telecom\u00admu\u00adni\u00adca\u00adtions lines are gen\u00ader\u00adal\u00adly exclud\u00aded from the pro\u00adcure\u00adment reg\u00adu\u00adla\u00adtions, pub\u00adlic con\u00adtract\u00ading author\u00adi\u00adties can and must apply the pro\u00advi\u00adsions of the KonzVgV and VgV, which stip\u00adu\u00adlate the fund\u00ading con\u00addi\u00adtions.  <\/p>\n\n<p class=\"wp-block-paragraph\">The judges thus fol\u00adlowed the line of the High\u00ader Admin\u00adis\u00adtra\u00adtive Court of Sax\u00adony, which had already ruled that a pro\u00adce\u00addure may be based on the require\u00adments of the KonzVgV and VgV as a whole. The deci\u00adsive fac\u00adtor is not whether it is for\u00admal\u00adly a con\u00adces\u00adsion or a con\u00adtract, but that the fund\u00ading deci\u00adsions require trans\u00adparen\u00adcy, equal treat\u00adment and non-dis\u00adcrim\u00adi\u00adna\u00adtion.   <\/p>\n\n<p class=\"wp-block-paragraph\">The ref\u00ader\u00adence in the ten\u00adder doc\u00adu\u00adments (\u201ctwo-stage pro\u00adce\u00addure with a pre\u00adlim\u00adi\u00adnary com\u00adpe\u00adti\u00adtion\u201d) was suf\u00adfi\u00adcient for the court. An explic\u00adit men\u00adtion of all reg\u00adu\u00adla\u00adtions in the con\u00adtract notice \u2014 as required by the VK S\u00fcd\u00adbay\u00adern \u2014 was not nec\u00ades\u00adsary.   <\/p>\n\n<p class=\"wp-block-paragraph\">Con\u00adse\u00adquence: The exclu\u00adsion of the offer due to mixed cal\u00adcu\u00adla\u00adtion and inad\u00ade\u00adquate prices was law\u00adful.  <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Tips for pub\u00adlic clients<\/strong> <\/h2>\n\n<ul class=\"wp-block-list\">\n<li>Check fund\u00ading deci\u00adsions care\u00adful\u00adly: These often require the appli\u00adca\u00adtion of the prin\u00adci\u00adples of pub\u00adlic pro\u00adcure\u00adment law \u2014 even if a sec\u00adtor excep\u00adtion applies.  <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Cre\u00adate trans\u00adparen\u00adcy: A clear ref\u00ader\u00adence in the ten\u00adder doc\u00adu\u00adments is usu\u00adal\u00adly suf\u00adfi\u00adcient to ensure the applic\u00ada\u00adbil\u00adi\u00adty of the KonzVgV\/VgV.  <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Observe doc\u00adu\u00admen\u00adta\u00adtion: Par\u00adtic\u00adu\u00adlar\u00adly in the case of price clar\u00adi\u00adfi\u00adca\u00adtions and exclu\u00adsions, a com\u00adpre\u00adhen\u00adsi\u00adble jus\u00adti\u00adfi\u00adca\u00adtion is cru\u00adcial.  <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Tips for bid\u00adders and fund\u00ading recip\u00adi\u00adents<\/strong> <\/h2>\n\n<ul class=\"wp-block-list\">\n<li>Read the ten\u00adder doc\u00adu\u00adments care\u00adful\u00adly: Even if the area excep\u00adtion applies, the rules of the KonzVgV\/VgV may still apply.  <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Sub\u00admit a plau\u00adsi\u00adble cal\u00adcu\u00adla\u00adtion: Incom\u00adplete or mixed price details quick\u00adly lead to exclu\u00adsion.  <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>Ensure trans\u00adparen\u00adcy: Safe\u00adty sur\u00adcharges or unusu\u00adal\u00adly low prices must be doc\u00adu\u00adment\u00aded in a com\u00adpre\u00adhen\u00adsi\u00adble and reli\u00adable man\u00adner.  <\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>On August 22, 2025, our lawyer Daniel Sch\u00f6lzel dealt with the deci\u00adsion of the Darm\u00adstadt Admin\u00adis\u00adtra\u00adtive Court of April 1, 2025 (Ref.: 7 L 2856\/24) in a LinkedIn live on pub\u00adlic pro\u00adcure\u00adment law.
