{"id":23374,"date":"2025-12-19T12:19:19","date_gmt":"2025-12-19T11:19:19","guid":{"rendered":"https:\/\/abante.de\/transparency-in-the-award-procedure-bverwg-specifies-bidders-rights-to-information\/"},"modified":"2026-02-19T11:33:36","modified_gmt":"2026-02-19T10:33:36","slug":"transparency-in-the-award-procedure-bverwg-specifies-bidders-rights-to-information","status":"publish","type":"post","link":"https:\/\/abante.de\/en\/transparency-in-the-award-procedure-bverwg-specifies-bidders-rights-to-information\/","title":{"rendered":"Trans\u00adparen\u00adcy in the award pro\u00adce\u00addure: BVer\u00adwG spec\u00adi\u00adfies bid\u00adders\u2019 rights to infor\u00adma\u00adtion"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A recent rul\u00ading by the Fed\u00ader\u00adal Admin\u00adis\u00adtra\u00adtive Court (BVer\u00adwG 10 C 5.24 \u2014 rul\u00ading from Decem\u00adber 17, 2025) pro\u00advides fur\u00adther clar\u00adi\u00adty: bid\u00adders have a right to access the eval\u00adu\u00ada\u00adtion of their own bid after the con\u00adclu\u00adsion of an award pro\u00adce\u00addure \u2014 based on the Free\u00addom of Infor\u00adma\u00adtion Act (IFG).<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>The case: Access to infor\u00adma\u00adtion under the IFG<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">In the under\u00adly\u00ading case, a plain\u00adtiff unsuc\u00adcess\u00adful\u00adly par\u00adtic\u00adi\u00adpat\u00aded in a call for ten\u00adders by the Fed\u00ader\u00adal Employ\u00adment Agency. With\u00adout ini\u00adti\u00adat\u00ading a review pro\u00adce\u00addure, it request\u00aded access to the doc\u00adu\u00admen\u00adta\u00adtion of the eval\u00adu\u00ada\u00adtion of its own bids, cit\u00ading the IFG. After the low\u00ader court (VGH Munich, VGH 5 BV 22.1295 \u2014 judg\u00adment of June 21, 2024) had already ruled in favor of the plain\u00adtiff, the BVer\u00adwG has now also con\u00adfirmed this claim.  <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>The deci\u00adsion: Pub\u00adlic pro\u00adcure\u00adment law does not con\u00adflict with IFG<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The defen\u00addan\u00adt\u2019s appeal was unsuc\u00adcess\u00adful. The BVer\u00adwG clar\u00adi\u00adfied that pub\u00adlic pro\u00adcure\u00adment reg\u00adu\u00adla\u00adtions do not take prece\u00addence over the Free\u00addom of Infor\u00adma\u00adtion Act once the pro\u00adceed\u00adings have been con\u00adclud\u00aded. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Key points of the deci\u00adsion:<\/strong><\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>Pro\u00adtec\u00adtive pur\u00adpose of the VgV:<\/strong> Sec\u00adtion 5 (2) sen\u00adtence 2 VgV pro\u00adtects com\u00adpa\u00adny infor\u00adma\u00adtion from being dis\u00adclosed to third par\u00adties. <\/li>\n\n\n\n<li><strong>No exclu\u00adsion for self-assess\u00adment:<\/strong> This pro\u00adtec\u00adtion does not apply if a bid\u00adder only requests infor\u00adma\u00adtion on the assess\u00adment of its own bid.<\/li>\n\n\n\n<li><strong>Com\u00adpet\u00adi\u00adtive neu\u00adtral\u00adi\u00adty:<\/strong> There is no anti-com\u00adpet\u00adi\u00adtive advan\u00adtage, as access to infor\u00adma\u00adtion is in prin\u00adci\u00adple also open to com\u00adpet\u00ading bid\u00adders.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Clas\u00adsi\u00adfi\u00adca\u00adtion: The pub\u00adlic pro\u00adcure\u00adment law per\u00adspec\u00adtive<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">While the BVer\u00adwG\u2019s deci\u00adsion pri\u00admar\u00adi\u00adly con\u00adfirms the admin\u00adis\u00adtra\u00adtive law per\u00adspec\u00adtive on access to infor\u00adma\u00adtion on one\u2019s own bid, the more far-reach\u00ading per\u00adspec\u00adtive under pub\u00adlic pro\u00adcure\u00adment law is also rel\u00ade\u00advant in prac\u00adtice.<\/p>\n\n<p class=\"wp-block-paragraph\">The ECJ already clar\u00adi\u00adfied on 17.11.2022 (Case C\u201154\/21 \u2014 <em>ANTE A POLSKA and oth\u00aders<\/em>) that, under cer\u00adtain con\u00addi\u00adtions, there may even be rights to infor\u00adma\u00adtion regard\u00ading the eval\u00adu\u00ada\u00adtion of oth\u00ader bid\u00adders. The recent rul\u00ading by the Fed\u00ader\u00adal Admin\u00adis\u00adtra\u00adtive Court should fur\u00adther raise aware\u00adness of these con\u00adstel\u00adla\u00adtions and their prac\u00adti\u00adcal impli\u00adca\u00adtions.  <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Con\u00adclu\u00adsion for prac\u00adtice<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The afore\u00admen\u00adtioned deci\u00adsions under\u00adline the impor\u00adtance of trans\u00adpar\u00adent pro\u00adcure\u00adment pro\u00adce\u00addures.
