The Fed\u00ader\u00adal Gov\u00adern\u00admen\u00adt\u2019s goal is wor\u00adthy of all praise: pub\u00adlic pro\u00adcure\u00adment pro\u00adce\u00addures must be accel\u00ader\u00adat\u00aded. In par\u00adtic\u00adu\u00adlar, the award pro\u00adce\u00addures for major projects are to be com\u00adplet\u00aded much faster. How\u00adev\u00ader, asso\u00adci\u00ada\u00adtions and experts seem to be debat\u00ading whether the cur\u00adrent path towards accel\u00ader\u00ada\u00adtion is the right one. While sup\u00adport\u00aders cel\u00ade\u00adbrate the law as a nec\u00ades\u00adsary reform, crit\u00adics warn of an ero\u00adsion of cen\u00adtral prin\u00adci\u00adples of pub\u00adlic pro\u00adcure\u00adment law. <\/p>\n\n

Abo\u00adli\u00adtion of the sus\u00adpen\u00adsive effect<\/strong> <\/h2>\n\n

The planned abo\u00adli\u00adtion of the sus\u00adpen\u00adsive effect<\/a> of imme\u00addi\u00adate appeals against deci\u00adsions of the pub\u00adlic pro\u00adcure\u00adment tri\u00adbunals is viewed par\u00adtic\u00adu\u00adlar\u00adly crit\u00adi\u00adcal\u00adly. This change would mean that con\u00adtract\u00ading author\u00adi\u00adties would be able to pro\u00adceed with the award of con\u00adtracts even if a com\u00adpa\u00adny is still tak\u00ading legal action against a deci\u00adsion. <\/p>\n\n

Some experts see this as a com\u00adpre\u00adhen\u00adsive dis\u00aden\u00adfran\u00adchise\u00adment of bid\u00adders who want to defend them\u00adselves against incor\u00adrect deci\u00adsions. <\/p>\n\n

Between effi\u00adcien\u00adcy and the rule of law<\/strong> <\/h2>\n\n

The polit\u00adi\u00adcal thrust of the law \u2014 faster pro\u00adce\u00addures for urgent\u00adly need\u00aded infra\u00adstruc\u00adture projects \u2014 is under\u00adstand\u00adable. How\u00adev\u00ader, in addi\u00adtion to the abo\u00adli\u00adtion of legal pro\u00adtec\u00adtion instru\u00adments, the soft\u00aden\u00ading of the lot prin\u00adci\u00adple also appears to raise ques\u00adtions about the rule of law.
