The sys\u00adtem was intend\u00aded to reduce park\u00ading search traf\u00adfic by dis\u00adplay\u00ading free capac\u00adi\u00adties, in par\u00adtic\u00adu\u00adlar for <strong>spe\u00adcif\u00adic vehi\u00adcle types (e.g. motorhomes)<\/strong>.   <\/p>\n\n<p class=\"wp-block-paragraph\">The con\u00adtract was ini\u00adtial\u00adly award\u00aded <strong>nation\u00adal\u00adly in accor\u00addance with VOB\/A<\/strong> and was described as a <strong>\u201ccon\u00adstruc\u00adtion mea\u00adsure\u201d<\/strong> with an esti\u00admat\u00aded con\u00adtract val\u00adue of 1.39 mil\u00adlion euros. The spec\u00adi\u00adfi\u00adca\u00adtions con\u00adtained the titles \u201cCiv\u00adil engi\u00adneer\u00ading\u201d and \u201cDis\u00adplay ele\u00adments and con\u00adtrol\u201d. In addi\u00adtion to the price (70%), the con\u00adcept (20%<strong>)<\/strong> and ener\u00adgy con\u00adsump\u00adtion (10%) were defined as award cri\u00adte\u00adria. The con\u00adcept for detec\u00adtion accu\u00adra\u00adcy had to achieve a <strong>min\u00adi\u00admum score in<\/strong> order not to be exclud\u00aded.     <\/p>\n\n<p class=\"wp-block-paragraph\">One bid\u00adder, spe\u00adcial\u00adiz\u00ading in elec\u00adtri\u00adcal instal\u00adla\u00adtion sys\u00adtems, object\u00aded to the ten\u00adder. He was of the opin\u00adion that it was a <strong>sup\u00adply and ser\u00advice con\u00adtract<\/strong> and should have been put out to ten\u00adder <strong>through\u00adout Europe<\/strong> because the rel\u00ade\u00advant EU thresh\u00adold had been exceed\u00aded. Fur\u00adther\u00admore, he crit\u00adi\u00adcized the fail\u00adure to <strong>divide<\/strong> the civ\u00adil engi\u00adneer\u00ading ser\u00advices <strong>into lots<\/strong>. The North Bavar\u00adi\u00adan Pub\u00adlic Pro\u00adcure\u00adment Cham\u00adber reject\u00aded the appli\u00adca\u00adtion, as the val\u00adue share of the con\u00adstruc\u00adtion ser\u00advices (approx. 40\u201349% of the total val\u00adue) was the main focus.     <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Key point of the deci\u00adsion: The true main object lies in the func\u00adtion<\/strong> <\/h2>\n\n<p class=\"wp-block-paragraph\">The Bay\u00adObLG over\u00adturned the deci\u00adsion of the pro\u00adcure\u00adment cham\u00adber and ruled in favor of the appli\u00adcant. It found that the con\u00adtract\u00ading author\u00adi\u00adty must <strong>put<\/strong> the con\u00adtract <strong>out to ten\u00adder through\u00adout Europe and divide it into lots<\/strong>.   <\/p>\n\n<h3 class=\"wp-block-heading\">1. qual\u00adi\u00adfi\u00adca\u00adtion of the order: func\u00adtion takes prece\u00addence over val\u00adue  <\/h3>\n\n<p class=\"wp-block-paragraph\">In the case of a mixed con\u00adtract (con\u00adstruc\u00adtion and sup\u00adply and ser\u00advices), the main sub\u00adject mat\u00adter must be deter\u00admined on the basis of the over\u00adall legal and eco\u00adnom\u00adic cir\u00adcum\u00adstances.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Role of the val\u00adue shares:<\/strong> The val\u00adue of the con\u00adstruc\u00adtion ser\u00advices (here approx. 40\u201349%) only has an <strong>ori\u00aden\u00adta\u00adtion and con\u00adtrol func\u00adtion<\/strong>. There are <strong>no fixed val\u00adue lim\u00adits<\/strong>.   <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Focus on ser\u00advices:<\/strong> The court saw the focus on the <strong>sup\u00adply and ser\u00advices<\/strong>. The <strong>con\u00adtract was char\u00adac\u00adter\u00adized<\/strong> by the design and con\u00adstruc\u00adtion of the park\u00ading guid\u00adance sys\u00adtem, not by the required con\u00adstruc\u00adtion ser\u00advices.   <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>The deci\u00adsive fac\u00adtor is the pur\u00adpose:<\/strong> the pur\u00adpose of the con\u00adtract was to <strong>opti\u00admize the use of<\/strong> the exist\u00ading park\u00ading spaces and to <strong>reg\u00adu\u00adlate traf\u00adfic<\/strong>, not to inter\u00advene in the con\u00adstruc\u00adtion.  <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Indi\u00adca\u00adtor award cri\u00adte\u00adri\u00adon:<\/strong> The out\u00adstand\u00ading impor\u00adtance of the cri\u00adte\u00adri\u00adon <strong>\u201ccon\u00adcept\u201d<\/strong> (detec\u00adtion accu\u00adra\u00adcy and effort for recal\u00adi\u00adbra\u00adtion) showed that the tech\u00adni\u00adcal solu\u00adtions for <strong>data acqui\u00adsi\u00adtion<\/strong> and not the civ\u00adil engi\u00adneer\u00ading work were the for\u00adma\u00adtive part of the con\u00adtract.  <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">2. vio\u00adla\u00adtion of the require\u00adment to award lots  <\/h3>\n\n<p class=\"wp-block-paragraph\">The con\u00adtract\u00ading author\u00adi\u00adty vio\u00adlat\u00aded Sec\u00adtion 97 (4) sen\u00adtences 2 and 3 GWB.   <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Lot award\u00ading as a rule:<\/strong> As there is a <strong>sep\u00ada\u00adrate mar\u00adket<\/strong> for civ\u00adil engi\u00adneer\u00ading and park\u00ading guid\u00adance sys\u00adtem ser\u00advices, the <strong>cre\u00adation of spe\u00adcial\u00adist lots<\/strong> was gen\u00ader\u00adal\u00adly required.  <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>No suf\u00adfi\u00adcient doc\u00adu\u00admen\u00adta\u00adtion:<\/strong> The excep\u00adtion to the prin\u00adci\u00adple of award\u00ading lots (over\u00adall award) must be jus\u00adti\u00adfied by a <strong>com\u00adpre\u00adhen\u00adsive con\u00adsid\u00ader\u00ada\u00adtion of<\/strong> the con\u00adflict\u00ading inter\u00adests, where\u00adby the rea\u00adsons for the over\u00adall award must <strong>pre\u00advail<\/strong>. The client had <strong>not doc\u00adu\u00adment\u00aded<\/strong> its con\u00adsid\u00ader\u00ada\u00adtions pri\u00ador to the announce\u00adment, which already con\u00adsti\u00adtutes an error.   <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Insuf\u00adfi\u00adcient jus\u00adti\u00adfi\u00adca\u00adtion:<\/strong> The <strong>gen\u00ader\u00adal\u00adly asso\u00adci\u00adat\u00aded coor\u00addi\u00adna\u00adtion effort<\/strong>, a poten\u00adtial <strong>cost risk<\/strong> or the risk of a <strong>time delay<\/strong> <strong>can\u00adnot<\/strong> jus\u00adti\u00adfy an over\u00adall award <strong>on their own<\/strong>.  <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Tips for pub\u00adlic clients: focus and con\u00adsid\u00ader\u00ada\u00adtion<\/strong> <\/h2>\n\n<p class=\"wp-block-paragraph\">The deci\u00adsion is a strong sig\u00adnal that the <strong>for\u00admal des\u00adig\u00adna\u00adtion<\/strong> of a con\u00adtract or the pure <strong>val\u00adue share of<\/strong> a ser\u00advice does not deter\u00admine the applic\u00ada\u00adble pro\u00adcure\u00adment reg\u00adu\u00adla\u00adtions.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Qual\u00adi\u00adta\u00adtive over\u00adall assess\u00adment:<\/strong> In the case of <strong>mixed con\u00adtracts<\/strong>, the <strong>func\u00adtion\u00adal pur\u00adpose<\/strong> of the project is deci\u00adsive. Ask your\u00adself: What is the <strong>con\u00adtrac\u00adtu\u00adal oblig\u00ada\u00adtion<\/strong>? Is it the con\u00adstruc\u00adtion of a build\u00ading (con\u00adstruc\u00adtion con\u00adtract) or the inte\u00adgra\u00adtion of a com\u00adplex tech\u00adni\u00adcal solu\u00adtion for opti\u00admiza\u00adtion (supply\/service con\u00adtract)?    <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Lot award\u00ading as a prin\u00adci\u00adple:<\/strong> <strong>Lot award\u00ading<\/strong> is the rule. An <strong>over\u00adall award<\/strong> is only per\u00admit\u00adted in the case of com\u00adpelling <strong>eco\u00adnom\u00adic or tech\u00adni\u00adcal rea\u00adsons<\/strong> that require a com\u00adpre\u00adhen\u00adsive <strong>assess\u00adment<\/strong> and clear\u00adly out\u00adweigh the rea\u00adsons.   <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Exclu\u00adsion of stan\u00addard rea\u00adsons:<\/strong> Typ\u00adi\u00adcal risks such as an increased <strong>coor\u00addi\u00adna\u00adtion effort, war\u00adran\u00adty issues, gen\u00ader\u00adal cost risk or slight time delays<\/strong> <strong>do not<\/strong> jus\u00adti\u00adfy an over\u00adall award.  <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Doc\u00adu\u00admen\u00adta\u00adtion oblig\u00ada\u00adtion:<\/strong> The deci\u00adsion not to award the lot must be <strong>com\u00adpre\u00adhen\u00adsive\u00adly doc\u00adu\u00adment\u00aded<\/strong> <strong>before the announce\u00adment<\/strong>. Post\u00adpon\u00ading rea\u00adsons is high\u00adly risky and insuf\u00adfi\u00adcient in the event of a dis\u00adpute.   <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Tips for bid\u00adders and appli\u00adcants: Check lot for\u00adma\u00adtion and legal process<\/strong> <\/h2>\n\n<p class=\"wp-block-paragraph\">The rul\u00ading shows that bid\u00adders can <strong>suc\u00adcess\u00adful\u00adly take legal action<\/strong> even in the case of sup\u00adpos\u00aded\u00adly clear-cut nation\u00adal con\u00adstruc\u00adtion ten\u00adders.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Check\u00ading the main sub\u00adject mat\u00adter:<\/strong> If you feel exclud\u00aded from par\u00adtic\u00adi\u00adpa\u00adtion due to the <strong>mixed nature<\/strong> (con\u00adstruc\u00adtion and technology\/IT), check whether the actu\u00adal <strong>focus of<\/strong> the ser\u00advice is on the sup\u00adply of goods and ser\u00advices. The <strong>low\u00ader thresh\u00adold val\u00adue<\/strong> for sup\u00adplies and ser\u00advices opens up the <strong>upper thresh\u00adold legal pro\u00adtec\u00adtion<\/strong>.   <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Objec\u00adtion to the over\u00adall award:<\/strong> Check whether a <strong>spe\u00adcial\u00adized lot for\u00adma\u00adtion<\/strong> would be pos\u00adsi\u00adble. The client must pro\u00advide detailed rea\u00adsons for an <strong>over\u00adall award<\/strong>.
