The case in ques\u00adtion involved the award of a gen\u00ader\u00adal con\u00adtrac\u00adtor con\u00adtract for the con\u00adstruc\u00adtion of a new bridge with a tem\u00adpo\u00adrary bypass.   <\/p>\n\n<p class=\"wp-block-paragraph\">Our video dis\u00adcussing the judg\u00adment:<\/p>\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe hcb-fetch-image-from=\"https:\/\/youtu.be\/PQmgqRLJKKY\" title=\"Gesamtvergabe bei technischer Verflechtung vergaberechtskonform!\" width=\"800\" height=\"450\" src=\"https:\/\/www.youtube.com\/embed\/PQmgqRLJKKY?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n<h2 class=\"wp-block-heading\"><strong>Facts: New bridge con\u00adstruc\u00adtion, nar\u00adrow con\u00adstruc\u00adtion area and required opti\u00admiza\u00adtion<\/strong> <\/h2>\n\n<p class=\"wp-block-paragraph\">The spe\u00adcif\u00adic case con\u00adcerned an open pro\u00adce\u00addure for the replace\u00adment con\u00adstruc\u00adtion of a bridge includ\u00ading the con\u00adstruc\u00adtion of a tem\u00adpo\u00adrary bypass. The con\u00adtract\u00ading author\u00adi\u00adty put the project out to ten\u00adder as an over\u00adall award to a gen\u00ader\u00adal con\u00adtrac\u00adtor (GC). The ser\u00advices to be pro\u00advid\u00aded com\u00adprised a large num\u00adber of indi\u00advid\u00adual ser\u00advices, includ\u00ading demo\u00adli\u00adtion and dis\u00adman\u00adtling work, spe\u00adcial civ\u00adil engi\u00adneer\u00ading, earth\u00adworks and exca\u00adva\u00adtion work as well as the relo\u00adca\u00adtion of pipelines.    <\/p>\n\n<p class=\"wp-block-paragraph\">The award cri\u00adte\u00adria were: Price (70 %) and the design of the con\u00adstruc\u00adtion process with pos\u00adsi\u00adble opti\u00admiza\u00adtions (30 %).  <\/p>\n\n<p class=\"wp-block-paragraph\">One bid\u00adder object\u00aded to the lack of lot for\u00adma\u00adtion, as the demo\u00adli\u00adtion work, spe\u00adcial civ\u00adil engi\u00adneer\u00ading and earth\u00adworks each con\u00adsti\u00adtut\u00aded sep\u00ada\u00adrate spe\u00adcial\u00adist lots and could be award\u00aded sep\u00ada\u00adrate\u00adly. After the Ag did not rem\u00ade\u00addy the com\u00adplaint, the bid\u00adder filed an appli\u00adca\u00adtion for review with the VK Bund.   <\/p>\n\n<p class=\"wp-block-paragraph\">The clien\u00adt\u2019s rea\u00adsons for award\u00ading the con\u00adtract as a whole includ\u00aded the close inter\u00adlink\u00ading of the trades, the inef\u00adfi\u00adcien\u00adcy of award\u00ading the con\u00adtract in lots (ref\u00ader\u00adence to the con\u00adstruc\u00adtion phase plans), the war\u00adran\u00adty issues and the pre\u00addict\u00aded exten\u00adsion of the con\u00adstruc\u00adtion peri\u00adod if lots were formed. In addi\u00adtion, coor\u00addi\u00adna\u00adtion with the pro\u00adduc\u00adtion cycles of a neigh\u00adbor\u00ading elec\u00adtri\u00adcal steel\u00adworks was essen\u00adtial due to the required block\u00ading peri\u00adods and required very tight tim\u00ading of all con\u00adstruc\u00adtion work.   <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Key point of the deci\u00adsion: When tech\u00adni\u00adcal rea\u00adsons jus\u00adti\u00adfy the over\u00adall award<\/strong> <\/h2>\n\n<p class=\"wp-block-paragraph\">The appli\u00adca\u00adtion for review was reject\u00aded as unfound\u00aded. The VK Bund con\u00adfirmed the legal\u00adi\u00adty of the over\u00adall award.   <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>1. prin\u00adci\u00adple of lot allo\u00adca\u00adtion vs. excep\u00adtion\u00adal case<\/strong> <\/h3>\n\n<p class=\"wp-block-paragraph\">The statu\u00adto\u00adry prin\u00adci\u00adple in Sec\u00adtion 97 (4) sen\u00adtence 2 GWB (or Sec\u00adtion 5 (2) no. 1 sen\u00adtence 2 VOB\/A EU) pro\u00advides for ser\u00advices to be award\u00aded in par\u00adtial lots (quan\u00adti\u00adty) and spe\u00adcial\u00adist lots (type or spe\u00adcial\u00adist area). The Cham\u00adber con\u00adfirmed that there are sep\u00ada\u00adrate mar\u00adkets for the ser\u00advices in dis\u00adpute, such as earth\u00adworks and spe\u00adcial\u00adist civ\u00adil engi\u00adneer\u00ading work as well as demo\u00adli\u00adtion, and that there are there\u00adfore spe\u00adcial\u00adist lots.    <\/p>\n\n<p class=\"wp-block-paragraph\">How\u00adev\u00ader, the excep\u00adtion of Sec\u00adtion 97 (4) sen\u00adtence 3 GWB (or Sec\u00adtion 5 (2) no. 1 sen\u00adtence 3 VOB\/A EU) applies, accord\u00ading to which an over\u00adall award is per\u00admis\u00adsi\u00adble if eco\u00adnom\u00adic or tech\u00adni\u00adcal rea\u00adsons make this nec\u00ades\u00adsary.   <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>2. weight\u00ading of the tech\u00adni\u00adcal rea\u00adsons<\/strong> <\/h3>\n\n<p class=\"wp-block-paragraph\">The VK Bund found that the tech\u00adni\u00adcal rea\u00adsons pre\u00addom\u00adi\u00adnat\u00aded in this indi\u00advid\u00adual case. Tech\u00adni\u00adcal rea\u00adsons there\u00adfore exist if:   <\/p>\n\n<ul class=\"wp-block-list\">\n<li>They make it nec\u00ades\u00adsary to <strong>inte\u00adgrate all ser\u00advice steps under one roof<\/strong> in order to achieve the <strong>lev\u00adel of qual\u00adi\u00adty aimed for<\/strong> by the client.  <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li>In the case of sep\u00ada\u00adrate ten\u00adders, there is a <strong>risk<\/strong> of receiv\u00ading <strong>par\u00adtial ser\u00advices<\/strong> which, although indi\u00advid\u00adu\u00adal\u00adly com\u00adpli\u00adant with the ten\u00adder, <strong>do not fit togeth\u00ader<\/strong> as a whole and there\u00adfore do not meet the pro\u00adcure\u00adment require\u00adments in the <strong>desired qual\u00adi\u00adty<\/strong>.  <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>3. the argu\u00adments for the over\u00adall award<\/strong> <\/h3>\n\n<p class=\"wp-block-paragraph\">The VK Bund essen\u00adtial\u00adly based its deci\u00adsion on the fol\u00adlow\u00ading aspects, which togeth\u00ader jus\u00adti\u00adfied the excep\u00adtion:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Close tech\u00adni\u00adcal and tem\u00adpo\u00adral inte\u00adgra\u00adtion of the trades:<\/strong> Due to the com\u00adplex\u00adi\u00adty of build\u00ading a new bridge, the con\u00adstruc\u00adtion work could not be car\u00adried out suc\u00adces\u00adsive\u00adly one after the oth\u00ader, but had to be car\u00adried out in par\u00adal\u00adlel and recur\u00adrent\u00adly in sev\u00ader\u00adal con\u00adstruc\u00adtion phas\u00ades. The trades are inter\u00adlinked (e.g. demo\u00adli\u00adtion only after struc\u00adtur\u00adal safety\/concrete rein\u00adforce\u00adment), which requires spe\u00adcial mea\u00adsures <strong>from a sin\u00adgle source<\/strong>.   <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Coor\u00addi\u00adna\u00adtion effort and time flex\u00adi\u00adbil\u00adi\u00adty:<\/strong> The over\u00adall award to a gen\u00ader\u00adal con\u00adtrac\u00adtor ensures opti\u00admal coor\u00addi\u00adna\u00adtion of the repet\u00adi\u00adtive trades on the spa\u00adtial\u00adly lim\u00adit\u00aded con\u00adstruc\u00adtion site. If lots were award\u00aded, the agent would have to spec\u00adi\u00adfy <strong>exact exe\u00adcu\u00adtion dead\u00adlines<\/strong> for each lot, which would have pre\u00advent\u00aded the nec\u00ades\u00adsary <strong>flex\u00adi\u00adbil\u00adi\u00adty<\/strong> in the case of such a com\u00adplex and dynam\u00adic con\u00adstruc\u00adtion process. The esti\u00admat\u00aded exten\u00adsion of the con\u00adstruc\u00adtion peri\u00adod of up to two years if lots were divid\u00aded up was accept\u00aded as a weighty argu\u00adment.    <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Con\u00adsid\u00ader\u00ada\u00adtion of the qual\u00adi\u00adty cri\u00adte\u00adri\u00adon:<\/strong> The award cri\u00adte\u00adri\u00adon of <strong>design\u00ading the con\u00adstruc\u00adtion process with opti\u00admiza\u00adtion pro\u00adpos\u00adals<\/strong> only makes sense in the case of an over\u00adall award. The required opti\u00admiza\u00adtion refers pre\u00adcise\u00adly to the <strong>inter\u00adac\u00adtion of all trades and ser\u00advices<\/strong>. The <strong>pro\u00adcure\u00adment auton\u00ado\u00admy<\/strong> of the pub\u00adlic author\u00adi\u00adty to make use of the exper\u00adtise of the spe\u00adcial\u00adist com\u00adpa\u00adnies to opti\u00admize the over\u00adall project would be cur\u00adtailed if lots were award\u00aded.    <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Pub\u00adlic inter\u00adest:<\/strong> The <strong>risk of col\u00adlapse of<\/strong> the exist\u00ading bridge and the asso\u00adci\u00adat\u00aded high pub\u00adlic inter\u00adest in remov\u00ading the source of dan\u00adger as quick\u00adly as pos\u00adsi\u00adble flank the tech\u00adni\u00adcal rea\u00adsons.  <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Tips for pub\u00adlic clients<\/strong> <\/h2>\n\n<p class=\"wp-block-paragraph\">The deci\u00adsion is an impor\u00adtant con\u00adfir\u00adma\u00adtion of the pos\u00adsi\u00adbil\u00adi\u00adty of the over\u00adall award, but sets high stan\u00addards for the jus\u00adti\u00adfi\u00adca\u00adtion.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Doc\u00adu\u00adment com\u00adpre\u00adhen\u00adsive con\u00adsid\u00ader\u00ada\u00adtion:<\/strong> When decid\u00ading against award\u00ading a lot, you must always <strong>weigh up<\/strong> and <strong>doc\u00adu\u00adment<\/strong> the <strong>con\u00adflict\u00ading inter\u00adests<\/strong> <strong>com\u00adpre\u00adhen\u00adsive\u00adly<\/strong>. It is not enough if the rea\u00adsons are wor\u00adthy of recog\u00adni\u00adtion \u2014 <strong>they must pre\u00advail<\/strong>. List at least one anchor point in the award notice, which can be sup\u00adple\u00adment\u00aded by sub\u00adse\u00adquent rea\u00adsons in the review pro\u00adce\u00addure.    <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Focus on tech\u00adni\u00adcal inter\u00adlink\u00ading:<\/strong> Con\u00adcen\u00adtrate on argu\u00adments that demon\u00adstrate an <strong>indis\u00adpens\u00adable tech\u00adni\u00adcal and\/or tem\u00adpo\u00adral inter\u00adlink\u00ading of<\/strong> the trades. This is par\u00adtic\u00adu\u00adlar\u00adly rel\u00ade\u00advant for com\u00adplex infra\u00adstruc\u00adture projects in which trades inter\u00adlock or are repeat\u00aded sev\u00ader\u00adal times.   <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Use qual\u00adi\u00adty and opti\u00admiza\u00adtion:<\/strong> Include <strong>objec\u00adti\u00adfi\u00adable qual\u00adi\u00adty lev\u00adels<\/strong> and the <strong>pos\u00adsi\u00adbil\u00adi\u00adty of opti\u00admiza\u00adtion<\/strong> of the over\u00adall project by the bid\u00adder as an award cri\u00adte\u00adri\u00adon in the ten\u00adder doc\u00adu\u00adments. This strength\u00adens the argu\u00adment that the desired pro\u00adcure\u00adment require\u00adments can only be met through <strong>respon\u00adsi\u00adbil\u00adi\u00adty from a sin\u00adgle source<\/strong>.   <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\"><strong>Tips for bid\u00adders and fund\u00ading recip\u00adi\u00adents<\/strong> <\/h2>\n\n<p class=\"wp-block-paragraph\">As a bid\u00adder or grant recip\u00adi\u00adent, you should not reject an over\u00adall award as being con\u00adtrary to pro\u00adcure\u00adment law.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Check\u00ading the pro\u00adcure\u00adment require\u00adments:<\/strong> Check care\u00adful\u00adly whether the <strong>qual\u00adi\u00adty<\/strong> or <strong>opti\u00admiza\u00adtion<\/strong> required by the client can actu\u00adal\u00adly only be achieved through an over\u00adall award. The gen\u00ader\u00adal coor\u00addi\u00adna\u00adtion effort or war\u00adran\u00adty inter\u00adfaces alone are gen\u00ader\u00adal\u00adly <strong>not<\/strong> suf\u00adfi\u00adcient jus\u00adti\u00adfi\u00adca\u00adtion for an over\u00adall award.   <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Con\u00adcrete lot argu\u00admen\u00adta\u00adtion:<\/strong> If you sub\u00admit a com\u00adplaint, argue <strong>specif\u00adi\u00adcal\u00adly<\/strong> for the lots you are seek\u00ading and explain why the alleged <strong>tech\u00adni\u00adcal inter\u00adde\u00adpen\u00adden\u00adcies<\/strong> <strong>do not<\/strong> pre\u00advent sep\u00ada\u00adra\u00adbil\u00adi\u00adty.  <\/li>\n<\/ul>\n\n<ul class=\"wp-block-list\">\n<li><strong>Use the con\u00adcept:<\/strong> In the case of over\u00adall awards with the award cri\u00adte\u00adri\u00adon \u201cconcept\/construction process\u201d, bid\u00adders should make max\u00adi\u00admum use of their <strong>exper\u00adtise in opti\u00admiz\u00ading the con\u00adstruc\u00adtion process in<\/strong> order to gain a com\u00adpet\u00adi\u00adtive advan\u00adtage.  <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>abante<\/strong> Recht\u00adsan\u00adw\u00e4lte pro\u00advides ongo\u00ading sup\u00adport to pub\u00adlic clients and bid\u00adders in com\u00adplex con\u00adstruc\u00adtion and plan\u00adning pro\u00adcure\u00adment law.
