Among oth\u00ader things, this plan pro\u00advid\u00aded for the con\u00adstruc\u00adtion and com\u00admis\u00adsion\u00ading of new res\u00adcue sta\u00adtions. Three of these sta\u00adtions (10, 11 and 12) were includ\u00aded in the pro\u00adcure\u00adment focus.  <\/p>\n\n<p>One res\u00adcue sta\u00adtion (no. 12) was put out to ten\u00adder indi\u00advid\u00adu\u00adal\u00adly at nation\u00adal lev\u00adel, as the esti\u00admat\u00aded con\u00adtract val\u00adue was EUR 2.2 mil\u00adlion. As this val\u00adue was below the EU thresh\u00adold of over 5 mil\u00adlion euros for con\u00adstruc\u00adtion ser\u00advices, the con\u00adtract\u00ading author\u00adi\u00adty refrained from an EU-wide ten\u00adder. <\/p>\n\n<p>One bid\u00adder, whose offer only came in sec\u00adond place, object\u00aded to the ten\u00adder as inad\u00admis\u00adsi\u00adble. His argu\u00adment was that the new build\u00adings for res\u00adcue sta\u00adtions 10, 11 and 12 had to be con\u00adsid\u00adered as a sin\u00adgle con\u00adtract and their con\u00adtract val\u00adues added togeth\u00ader. If these had been added togeth\u00ader, the EU thresh\u00adold would have been exceed\u00aded, which would have made a Europe-wide ten\u00adder\u00ading pro\u00adce\u00addure nec\u00ades\u00adsary. If the thresh\u00adold had been exceed\u00aded, the bid\u00adder would have been enti\u00adtled to take legal action before the Pub\u00adlic Pro\u00adcure\u00adment Cham\u00adber.   <\/p>\n\n<h2 class=\"wp-block-heading\">Key point of the deci\u00adsion: Func\u00adtion\u00adal coher\u00adence<\/h2>\n\n<p>The VK West\u00adfalen reject\u00aded the appli\u00adca\u00adtion for review as inad\u00admis\u00adsi\u00adble, as the rel\u00ade\u00advant thresh\u00adold for the cham\u00adber\u2019s juris\u00addic\u00adtion was not reached.<\/p>\n\n<p>The Cham\u00adber clar\u00adi\u00adfied when con\u00adstruc\u00adtion ser\u00advices are part of an over\u00adall con\u00adtract:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>A sin\u00adgle build\u00ading:<\/strong> Con\u00adstruc\u00adtion ser\u00advices are part of a sin\u00adgle con\u00adtract if they are to be regard\u00aded as a sin\u00adgle build\u00ading <strong>from a func\u00adtion\u00adal point of view<\/strong>.<\/li>\n\n\n\n<li><strong>Inter\u00adnal coher\u00adence:<\/strong> This is the case if the dif\u00adfer\u00adent lots of the build\u00ading <strong>ful\u00adfill the same eco\u00adnom\u00adic and tech\u00adni\u00adcal func\u00adtion<\/strong>, i.e. if they are inter\u00adnal\u00adly coher\u00adent.<\/li>\n\n\n\n<li><strong>Delim\u00adi\u00adta\u00adtion:<\/strong> The Cham\u00adber does not fol\u00adlow the bid\u00adder\u2019s argu\u00admen\u00adta\u00adtion, as the indi\u00advid\u00adual res\u00adcue sta\u00adtions are able to func\u00adtion inde\u00adpen\u00addent\u00adly of each oth\u00ader.\n<ul class=\"wp-block-list\">\n<li><strong>No loss of func\u00adtion:<\/strong> The func\u00adtion of a res\u00adcue sta\u00adtion is not lost because anoth\u00ader, spa\u00adtial\u00adly dis\u00adtant sta\u00adtion is not built.<\/li>\n\n\n\n<li><strong>Inde\u00adpen\u00addent use:<\/strong> Each res\u00adcue sta\u00adtion can also func\u00adtion on its own, with\u00adout the oth\u00ader sta\u00adtions.<\/li>\n\n\n\n<li><strong>Too far-reach\u00ading argu\u00admen\u00adta\u00adtion:<\/strong> A mere orga\u00adni\u00adza\u00adtion\u00adal link, for exam\u00adple because all guards serve the same pur\u00adpose (res\u00adcue ser\u00advices), would lead to a bound\u00adless<strong> expan\u00adsion of the def\u00adi\u00adn\u00adi\u00adtion of the man\u00addate<\/strong> (e.g. to all schools or hos\u00adpi\u00adtals in a munic\u00adi\u00adpal\u00adi\u00adty) and should there\u00adfore be reject\u00aded.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<p>The VK West\u00adfalen ruled that the new con\u00adstruc\u00adtion of res\u00adcue sta\u00adtion 12 is not part of an over\u00adall con\u00adtract. Although the sta\u00adtions are orga\u00adni\u00adza\u00adtion\u00adal\u00adly linked and serve the same pur\u00adpose, the nec\u00ades\u00adsary func\u00adtion\u00adal con\u00adnec\u00adtion is miss\u00ading. <\/p>\n\n<h2 class=\"wp-block-heading\">Tips for pub\u00adlic clients: The right con\u00adtract val\u00adue esti\u00admate<\/h2>\n\n<p>The deci\u00adsion under\u00adlines the neces\u00adsi\u00adty of a care\u00adful and legal\u00adly com\u00adpli\u00adant con\u00adtract val\u00adue esti\u00admate as a fun\u00adda\u00admen\u00adtal basis for every pro\u00adcure\u00adment pro\u00adce\u00addure.<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Dif\u00adfer\u00aden\u00adti\u00adat\u00aded con\u00adsid\u00ader\u00ada\u00adtion of con\u00adstruc\u00adtion projects:<\/strong> Always check the func\u00adtion\u00adal and tech\u00adni\u00adcal inde\u00adpen\u00addence of sev\u00ader\u00adal sim\u00adi\u00adlar con\u00adstruc\u00adtion projects. A joint strate\u00adgic plan (such as the res\u00adcue ser\u00advice require\u00adment plan) or a joint source of fund\u00ading alone is not suf\u00adfi\u00adcient to form an over\u00adall con\u00adtract val\u00adue. The deci\u00adsive fac\u00adtor is whether one part of the ser\u00advice <strong>can\u00adnot ful\u00adfill a mean\u00ading\u00adful func\u00adtion<\/strong> with\u00adout the oth\u00ader.  <\/li>\n\n\n\n<li><strong>Doc\u00adu\u00admen\u00adta\u00adtion of the demar\u00adca\u00adtion:<\/strong> Doc\u00adu\u00adment trans\u00adpar\u00adent\u00adly why you assume sep\u00ada\u00adrate <strong>orders<\/strong> for spa\u00adtial\u00adly sep\u00ada\u00adrate and inde\u00adpen\u00addent\u00adly usable build\u00adings (even if they are sim\u00adi\u00adlar and serve the same over\u00adar\u00adch\u00ading pur\u00adpose). Use the cri\u00adte\u00adria of <strong>inter\u00adnal coher\u00adence <\/strong>as well as eco\u00adnom\u00adic and tech\u00adni\u00adcal func\u00adtion. <\/li>\n\n\n\n<li><strong>Stan\u00addard\u00adized plan\u00adning vs. over\u00adall con\u00adtract:<\/strong> If the con\u00adstruc\u00adtion work is sim\u00adi\u00adlar to sev\u00ader\u00adal objects, it is often mere\u00adly a case of stan\u00addard\u00adized plan\u00adning and not auto\u00admat\u00adi\u00adcal\u00adly an over\u00adall con\u00adtract in the sense of pub\u00adlic pro\u00adcure\u00adment law.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Tips for bid\u00adders and fund\u00ading recip\u00adi\u00adents: legal pro\u00adtec\u00adtion and com\u00adplaints<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Check\u00ading the thresh\u00adold val\u00adue cal\u00adcu\u00adla\u00adtion:<\/strong> In the case of a nation\u00adal invi\u00adta\u00adtion to ten\u00adder for appar\u00adent\u00adly divid\u00aded ser\u00advices, check whether the thresh\u00adold val\u00adues could be cir\u00adcum\u00advent\u00aded. A vio\u00adla\u00adtion of the addi\u00adtion rule of Sec\u00adtion 3 (7) VgV requires that the lots are<strong> func\u00adtion\u00adal\u00adly relat\u00aded <\/strong>as a <strong>sin\u00adgle con\u00adstruc\u00adtion<\/strong>.  <\/li>\n\n\n\n<li><strong>Dif\u00adfer\u00aden\u00adti\u00ada\u00adtion from the \u201cuni\u00adform build\u00ading\u201d:<\/strong> A com\u00adplaint is only suc\u00adcess\u00adful if you can prove that the indi\u00advid\u00adual orders do not func\u00adtion inde\u00adpen\u00addent\u00adly of each oth\u00ader and could<strong> not ful\u00adfill any mean\u00ading\u00adful func\u00adtion<\/strong> with\u00adout the oth\u00aders.
