In the sem\u00adi\u00adnar, <a href=\"https:\/\/abante.de\/en\/team-mitglieder\/josephine-buchholz\/\" data-type=\"team-mitglieder\" data-id=\"22535\">lawyer Josephine Buch\u00adholz<\/a> explained the most impor\u00adtant dif\u00adfer\u00adences to the old legal sit\u00adu\u00ada\u00adtion in a prac\u00adti\u00adcal way.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>1 Who is affect\u00aded? The scope of appli\u00adca\u00adtion (\u00a7 1) <\/strong>  The TVergG LSA now focus\u00ades entire\u00adly on <strong>sub-thresh\u00adold awards<\/strong>. The pre\u00advi\u00adous prac\u00adtice of apply\u00ading state reg\u00adu\u00adla\u00adtions in addi\u00adtion to EU-wide pro\u00adce\u00addures has been removed. The new <strong>80\/20 rule<\/strong> for lot awards is par\u00adtic\u00adu\u00adlar\u00adly inter\u00adest\u00ading for con\u00adtract\u00ading author\u00adi\u00adties: The state pro\u00adcure\u00adment law no longer has to be applied to small lots that togeth\u00ader do not account for more than 20% of the total val\u00adue. In addi\u00adtion, <strong>free\u00adlance ser\u00advices<\/strong>, such as those pro\u00advid\u00aded by archi\u00adtects or lawyers, are now express\u00adly exclud\u00aded from the law; the UVgO pri\u00admar\u00adi\u00adly applies here. The lan\u00adguage has also been mod\u00adern\u00adized: instead of \u201cdirect award\u201d, we now speak uni\u00adform\u00adly of <strong>\u201cdirect con\u00adtract\u201d.<\/strong>    <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>2. more lee\u00adway: the new best bid\u00adder prin\u00adci\u00adple (Sec\u00adtion 8)<\/strong> The best bid\u00adder prin\u00adci\u00adple used to be a rigid oblig\u00ada\u00adtion. Now, con\u00adtract\u00ading author\u00adi\u00adties have real <strong>dis\u00adcre\u00adtion<\/strong>. They can decide for them\u00adselves whether and which evi\u00addence they require from the poten\u00adtial win\u00adner (the best bid\u00adder) after the eval\u00adu\u00ada\u00adtion. To save time, you can now even request doc\u00adu\u00adments from the sec\u00adond or third-placed bid\u00adders <strong>in par\u00adal\u00adlel<\/strong>. The dead\u00adlines have been made more flex\u00adi\u00adble and now <strong>range from three to ten cal\u00aden\u00addar days<\/strong>. A big plus point: if a bid\u00adder miss\u00ades the dead\u00adline, this no longer auto\u00admat\u00adi\u00adcal\u00adly leads to ejec\u00adtion. The client can decide whether to leave the bid in the run\u00adning any\u00adway \u2014 but this must then be well doc\u00adu\u00adment\u00aded.      <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>3. com\u00adpli\u00adance with col\u00adlec\u00adtive agree\u00adments and the new min\u00adi\u00admum wage (\u00a7 11)<\/strong> The rules on com\u00adpli\u00adance with col\u00adlec\u00adtive agree\u00adments now only apply to <strong>con\u00adstruc\u00adtion and ser\u00advices<\/strong> as well as local trans\u00adport. Deliv\u00adery ser\u00advices are exclud\u00aded, as they have less influ\u00adence on local work\u00ading con\u00addi\u00adtions. Impor\u00adtant for cost\u00ading: The min\u00adi\u00admum wage spe\u00adcif\u00adic to pro\u00adcure\u00adment is cur\u00adrent\u00adly <strong>EUR 15.67<\/strong> (as of Sep\u00adtem\u00adber 2025). What is new is that con\u00adtract\u00ading author\u00adi\u00adties must spec\u00adi\u00adfy the rel\u00ade\u00advant col\u00adlec\u00adtive agree\u00adment in the ten\u00adder doc\u00adu\u00adments to ensure clar\u00adi\u00adty for all bid\u00adders.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>4. lean\u00ader con\u00adtrols and dig\u00adi\u00adtal com\u00admu\u00adni\u00adca\u00adtion (\u00a7\u00a7 14, 17)<\/strong> We are becom\u00ading more dig\u00adi\u00adtal: sub\u00adcon\u00adtrac\u00adtors can now also be offi\u00adcial\u00adly <strong>named elec\u00adtron\u00adi\u00adcal\u00adly<\/strong>. The leg\u00adis\u00adla\u00adtor has cut back on checks. Clients must now only be able to check the remu\u00adner\u00ada\u00adtion state\u00adments of the <strong>main con\u00adtrac\u00adtor<\/strong>. The time-con\u00adsum\u00ading check\u00ading of sub\u00adcon\u00adtrac\u00adtors\u2019 con\u00adtracts for work and ser\u00advices or tax cer\u00adtifi\u00adcates is no longer nec\u00ades\u00adsary, which can mas\u00adsive\u00adly reduce the admin\u00adis\u00adtra\u00adtive bur\u00adden.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>5. the grad\u00adu\u00adat\u00aded sanc\u00adtion sys\u00adtem (\u00a7 18)<\/strong> Vio\u00adla\u00adtions of the law are now pun\u00adished accord\u00ading to a grad\u00adu\u00adat\u00aded mod\u00adel. This ranges from a warn\u00ading for minor errors (1%) to con\u00adtract ter\u00admi\u00adna\u00adtion or sus\u00adpen\u00adsion for seri\u00adous breach\u00ades of the main oblig\u00ada\u00adtions (5%).   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>6. faster pro\u00adce\u00addures thanks to new dead\u00adlines (\u00a7 19)<\/strong> All dead\u00adlines have been changed from work\u00ading days to <strong>cal\u00aden\u00addar days<\/strong>. This makes the cal\u00adcu\u00adla\u00adtion eas\u00adi\u00ader, but also short\u00adens the time win\u00addows. The wait\u00ading peri\u00adod before the con\u00adtract is award\u00aded is now only <strong>sev\u00aden cal\u00aden\u00addar days<\/strong>. This means that projects can start more quick\u00adly, but bid\u00adders must also react more quick\u00adly in the event of errors.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Con\u00adclu\u00adsion: Those who write, stay<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The reform brings a lot of flex\u00adi\u00adbil\u00adi\u00adty and less paper\u00adwork. But be care\u00adful: \u201cMore dis\u00adcre\u00adtion\u201d also means \u201cmore oblig\u00ada\u00adtion to give rea\u00adsons\u201d.
