Open house mod\u00adel \u2014 what is it?<\/h4>\n

Accord\u00ading to the now pre\u00advail\u00ading opin\u00adion, the con\u00adtract\u00ading author\u00adi\u00adty must make a selec\u00adtion deci\u00adsion in order for pub\u00adlic pro\u00adcure\u00adment law to apply. This is lack\u00ading in open house mod\u00adels. Indeed, dur\u00ading the term of an open house pro\u00adcure\u00adment, the Fund under\u00adtakes to enter into a con\u00adtract with each eco\u00adnom\u00adic oper\u00ada\u00adtor who, in turn, under\u00adtakes to pro\u00advide the sup\u00adplies in ques\u00adtion on pre\u00adde\u00adfined terms. And this with\u00adout mak\u00ading any fur\u00adther selec\u00adtion among the inter\u00adest\u00aded bid\u00adders and with the per\u00adma\u00adnent\u00adly exist\u00ading pos\u00adsi\u00adbil\u00adi\u00adty for inter\u00adest\u00aded com\u00adpa\u00adnies to join the open house sys\u00adtem dur\u00ading the term. And not only dur\u00ading an \u201centry phase\u201d, as the ECJ states, but dur\u00ading the entire term (see ECJ, judg\u00adment of 2.6.2016, Case C\u2011410\/14). All that is required, accord\u00ading to the ECJ, is a notice \u201cenabling poten\u00adtial\u00adly inter\u00adest\u00aded eco\u00adnom\u00adic oper\u00ada\u00adtors to take due note of the course and essen\u00adtial fea\u00adtures of an approval pro\u00adce\u00addure such as that at issue in the main pro\u00adceed\u00adings\u201d (ECJ, judg\u00adment of 2.6.2016, Case C\u2011410\/14).<\/p>\n

Con\u00adse\u00adquences for review under pro\u00adcure\u00adment law<\/h4>\n

The linch\u00adpin is first whether a selec\u00adtion deci\u00adsion has been made. If this is not the case, and if the con\u00adtract is oth\u00ader\u00adwise award\u00aded on the basis of the open house mod\u00adel, the con\u00adtract review author\u00adi\u00adties are unlike\u00adly to have juris\u00addic\u00adtion.<\/p>\n

It must be clar\u00adi\u00adfied whether, in the indi\u00advid\u00adual case, pro\u00adcure\u00adment is actu\u00adal\u00adly car\u00adried out by way of the open house mod\u00adel or whether the health insur\u00adance fund in ques\u00adtion has cho\u00adsen a false des\u00adig\u00adna\u00adtion, i.e., in sub\u00adstance, for exam\u00adple, con\u00adcludes a gen\u00aduine frame\u00adwork agree\u00adment sub\u00adject to pro\u00adcure\u00adment law, the award of which can also be reviewed by the pro\u00adcure\u00adment review bod\u00adies.<\/p>\n

This will have to be dis\u00adcussed at least if the rebate con\u00adtract is to be designed in such a way that, pure\u00adly for eco\u00adnom\u00adic rea\u00adsons, it is actu\u00adal\u00adly only pos\u00adsi\u00adble for a lim\u00adit\u00aded num\u00adber of bid\u00adders to join the open house mod\u00adel. How\u00adev\u00ader, this may also be the case if bid\u00adders are sim\u00adply told that they will not be admit\u00adted. In both cas\u00ades, the ques\u00adtion aris\u00ades as to whether a \u201cveiled selec\u00adtion deci\u00adsion\u201d is not being made.<\/p>\n

Review by oth\u00ader juris\u00addic\u00adtions<\/h4>\n

Irre\u00adspec\u00adtive of this, it must be checked in each indi\u00advid\u00adual case whether the spe\u00adcif\u00adic selec\u00adtion made, for exam\u00adple, by a physi\u00adcian or phar\u00adma\u00adcist, is legal\u00adly sound. This can then also be con\u00adtrolled by the courts, if nec\u00ades\u00adsary in sum\u00adma\u00adry pro\u00adceed\u00adings. Civ\u00adil and\/or social juris\u00addic\u00adtion is addressed here.<\/p>\n
