Not all, but most pub\u00adlic pro\u00adcure\u00adment law stan\u00addards grant bid\u00adder-pro\u00adtect\u00ading rights. It there\u00adfore requires the mem\u00adber states of the Euro\u00adpean Union to pro\u00advide for pub\u00adlic pro\u00adcure\u00adment review pro\u00adce\u00addures. <\/p><p>This is reg\u00adu\u00adlat\u00aded in the Reme\u00addies Direc\u00adtive; in its offi\u00adcial ver\u00adsion it is called \u201cDirec\u00adtive 2007\/66\/EC of the Euro\u00adpean Par\u00adlia\u00adment and of the Coun\u00adcil of Decem\u00adber 11, 2007 amend\u00ading Coun\u00adcil Direc\u00adtives 89\/665\/EEC and 92\/13\/EEC with regard to improv\u00ading the effec\u00adtive\u00adness of review pro\u00adce\u00addures con\u00adcern\u00ading the award of pub\u00adlic con\u00adtracts (Offi\u00adcial Jour\u00adnal of the Euro\u00adpean Union of Decem\u00adber 20, 2007 No. L 335, p. 31 et seq.), includ\u00ading the afore\u00admen\u00adtioned amend\u00aded direc\u00adtives\u201d. For the sake of sim\u00adplic\u00adi\u00adty, we will refer to this as the \u201cReme\u00addies Direc\u00adtive\u201d. <\/p><p>The Reme\u00addies Direc\u00adtive was imple\u00adment\u00aded in Ger\u00admany in Sec\u00adtions 155 et seq. GWB. Accord\u00ading to Sec\u00adtion 155 GWB, the award of pub\u00adlic con\u00adtracts and con\u00adces\u00adsions is sub\u00adject to review by the pub\u00adlic pro\u00adcure\u00adment cham\u00adbers. Pur\u00adsuant to Sec\u00adtion 156 (1) GWB, the fed\u00ader\u00adal pro\u00adcure\u00adment cham\u00adbers review pub\u00adlic con\u00adtracts and con\u00adces\u00adsions attrib\u00adut\u00adable to the fed\u00ader\u00adal gov\u00adern\u00adment, while the pro\u00adcure\u00adment cham\u00adbers of the fed\u00ader\u00adal states review pub\u00adlic con\u00adtracts and con\u00adces\u00adsions attrib\u00adut\u00adable to them. There are there\u00adfore fed\u00ader\u00adal pro\u00adcure\u00adment cham\u00adbers and pro\u00adcure\u00adment cham\u00adbers of the indi\u00advid\u00adual fed\u00ader\u00adal states. They decide with a chair\u00adman and two asses\u00adsors, where\u00adby at least one of the deci\u00adsion-mak\u00aders must be a ful\u00adly qual\u00adi\u00adfied lawyer, see Sec\u00adtion 157 (2) ARC. This speaks for the court char\u00adac\u00adter.    <\/p><p>At the same time, how\u00adev\u00ader, the pub\u00adlic pro\u00adcure\u00adment tri\u00adbunals are inte\u00adgrat\u00aded into the gen\u00ader\u00adal struc\u00adture of the author\u00adi\u00adties. More\u00adover, their full-time mem\u00adbers are civ\u00adil ser\u00advants and not judges. <\/p><p>There\u00adfore, pro\u00adcure\u00adment tri\u00adbunals are not courts, but they are sim\u00adi\u00adlar to courts. Their mem\u00adbers are inde\u00adpen\u00addent in their deci\u00adsions and gen\u00ader\u00adal\u00adly behave as such. A bid\u00adder or appli\u00adcant need not fear that their appli\u00adca\u00adtion will not be processed because it is \u201cnot approved\u201d. Their rights are also insti\u00adtu\u00adtion\u00adal\u00adly safe\u00adguard\u00aded by the estab\u00adlish\u00adment of inde\u00adpen\u00addent pro\u00adcure\u00adment tri\u00adbunals.   <\/p><h2>Is every award reviewed by the pro\u00adcure\u00adment cham\u00adber?<\/h2><p>The pro\u00adcure\u00adment cham\u00adber does not review every award. It would not even be in a posi\u00adtion to do so, as hun\u00addreds of award pro\u00adce\u00addures are car\u00adried out every day. Rather, it only acts upon request, cf. sec\u00adtion 160 (1) GWB. A bid\u00adder or can\u00addi\u00addate can make this request if they believe that their rights have been dis\u00adre\u00adgard\u00aded.    <\/p><p>At the same time, the pub\u00adlic pro\u00adcure\u00adment tri\u00adbunals in Ger\u00admany are not respon\u00adsi\u00adble for every award, even if a bid\u00adder requests a review of this award. This is because the Reme\u00addies Direc\u00adtive and the trans\u00adpo\u00adsi\u00adtion pro\u00advi\u00adsions in Sec\u00adtions 155 et seq. GWB only apply to above-thresh\u00adold awards. These are award pro\u00adce\u00addures for con\u00adtracts that reach the EU thresh\u00adolds. For sup\u00adply and ser\u00advice con\u00adtracts of nor\u00admal pub\u00adlic con\u00adtract\u00ading author\u00adi\u00adties, this is cur\u00adrent\u00adly (as of 1.1.2024) e.g. 221,000 euros net. For con\u00adstruc\u00adtion con\u00adtracts cur\u00adrent\u00adly 5.538 mil\u00adlion euros. This means that for low\u00ader-val\u00adue con\u00adtracts, the pro\u00adcure\u00adment cham\u00adber will declare that it has no juris\u00addic\u00adtion. It will reject an appli\u00adca\u00adtion for review relat\u00ading to such low-val\u00adue con\u00adtracts as inad\u00admis\u00adsi\u00adble. It should be not\u00aded, how\u00adev\u00ader, that very often it is not the val\u00adue of the indi\u00advid\u00adual con\u00adtract that mat\u00adters, but the val\u00adue of the entire (construction\/service) project, mean\u00ading that even low-val\u00adue con\u00adtracts of just a few tens of thou\u00adsands of euros may end up before the pro\u00adcure\u00adment cham\u00adber.       <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element
