If the bid\u00adder or can\u00addi\u00addate is con\u00advinced that the award pro\u00adce\u00addure was car\u00adried out incor\u00adrect\u00adly, they can ini\u00adti\u00adate a review pro\u00adce\u00addure through the respon\u00adsi\u00adble award cham\u00adber \u2014 usu\u00adal\u00adly after the com\u00adplaint has been raised, but before the con\u00adtract is award\u00aded. The pos\u00adsi\u00adbil\u00adi\u00adty of a review pro\u00adce\u00addure exists pri\u00admar\u00adi\u00adly in the above-thresh\u00adold area (in a few fed\u00ader\u00adal states also in the below-thresh\u00adold area) and is reg\u00adu\u00adlat\u00aded in Sec\u00adtions 160 et seq. GWB. <\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

Respon\u00adsi\u00adbil\u00adi\u00adty<\/h2>

The Pub\u00adlic Pro\u00adcure\u00adment Cham\u00adber decides on award pro\u00adce\u00addures whose sub\u00adject mat\u00adter is a pub\u00adlic con\u00adtract with\u00adin the mean\u00ading of Sec\u00adtion 103 GWB or a con\u00adces\u00adsion with\u00adin the mean\u00ading of Sec\u00adtion 105 GWB.<\/p>

Pub\u00adlic con\u00adtracts with\u00adin the mean\u00ading of Sec\u00adtion 103 (1) GWB <\/strong> are \u201ccon\u00adtracts for pecu\u00adniary inter\u00adest con\u00adclud\u00aded between con\u00adtract\u00ading author\u00adi\u00adties or con\u00adtract\u00ading enti\u00adties and under\u00adtak\u00adings for the pro\u00adcure\u00adment of ser\u00advices hav\u00ading as their object the sup\u00adply of goods, the exe\u00adcu\u00adtion of works or the pro\u00advi\u00adsion of ser\u00advices.\u201d<\/p>

Con\u00adces\u00adsions with\u00adin the mean\u00ading of Sec\u00adtion 105 ARC<\/strong> are con\u00adtracts for con\u00adsid\u00ader\u00ada\u00adtion in which com\u00adpa\u00adnies are com\u00admis\u00adsioned by con\u00adces\u00adsion grantors either with con\u00adstruc\u00adtion ser\u00advices, for which they receive the right to use the con\u00adstruc\u00adtion (plus a pay\u00adment, if applic\u00ada\u00adble) as con\u00adsid\u00ader\u00ada\u00adtion, or with the pro\u00advi\u00adsion and man\u00adage\u00adment of ser\u00advices, for which they receive the right to use the ser\u00advice (plus a pay\u00adment, if applic\u00ada\u00adble) as con\u00adsid\u00ader\u00ada\u00adtion.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

No sur\u00adcharge<\/h2>

The award pro\u00adce\u00addure ends with the award of the con\u00adtract by the con\u00adtract\u00ading author\u00adi\u00adty. The con\u00adtract award is the accep\u00adtance of a ten\u00adder, where\u00adby the con\u00adtract between the con\u00adtract\u00ading author\u00adi\u00adty and the suc\u00adcess\u00adful bid\u00adder is con\u00adclud\u00aded. In the upper thresh\u00adold area, con\u00adtract\u00ading author\u00adi\u00adties have an oblig\u00ada\u00adtion to inform and wait in accor\u00addance with Sec\u00adtion 134 (1) GWB. This means that the con\u00adtract\u00ading author\u00adi\u00adty informs the unsuc\u00adcess\u00adful bid\u00adders before award\u00ading the con\u00adtract that their bid will not be con\u00adsid\u00adered, when the ear\u00adli\u00adest pos\u00adsi\u00adble award date is and who is to be award\u00aded the con\u00adtract and for what rea\u00adsons. From the time this noti\u00adfi\u00adca\u00adtion is sent, there is a 15-day stand\u00adstill peri\u00adod dur\u00ading which the con\u00adtract may not be award\u00aded. This peri\u00adod can be short\u00adened to 10 days if cer\u00adtain for\u00admal require\u00adments are met; the peri\u00adod is usu\u00adal\u00adly short\u00adened. <\/p>

A review pro\u00adce\u00addure can only be suc\u00adcess\u00adful\u00adly ini\u00adti\u00adat\u00aded before the expiry of this peri\u00adod, i.e. only before the con\u00adtract is award\u00aded. Only in the case of par\u00adtic\u00adu\u00adlar\u00adly seri\u00adous breach\u00ades of the pro\u00adcure\u00adment reg\u00adu\u00adla\u00adtions (dis\u00adre\u00adgard of the infor\u00adma\u00adtion and wait\u00ading oblig\u00ada\u00adtion or award of the con\u00adtract with\u00adout the required ex ante pub\u00adli\u00adca\u00adtion of a notice in the Offi\u00adcial Jour\u00adnal of the Euro\u00adpean Union) is the con\u00adclud\u00aded con\u00adtract invalid pur\u00adsuant to Sec\u00adtion 135 (1) GWB. How\u00adev\u00ader, this inva\u00adlid\u00adi\u00adty can only be deter\u00admined in a review pro\u00adce\u00addure. The time lim\u00adits set out in Sec\u00adtion 135 (2) GWB apply to this. In the cas\u00ades of Sec\u00adtion 135 (1) GWB, a review pro\u00adce\u00addure (in the form of a nul\u00adli\u00adty deter\u00admi\u00adna\u00adtion pro\u00adce\u00addure) is there\u00adfore excep\u00adtion\u00adal\u00adly pos\u00adsi\u00adble after the con\u00adtract has been award\u00aded. As a rule, how\u00adev\u00ader, the appli\u00adca\u00adtion for review must be filed in good time so that it can be served before the con\u00adtract is award\u00aded. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

Form and con\u00adtent pur\u00adsuant to Sec\u00adtion 161 GWB<\/h2>

The appli\u00adca\u00adtion must be sub\u00admit\u00adted in writ\u00ading and sub\u00adstan\u00adti\u00adat\u00aded. The state\u00adment of grounds must include the name of the defen\u00addant, a descrip\u00adtion (as spe\u00adcif\u00adic as pos\u00adsi\u00adble) of the alleged infringe\u00adment and the evi\u00addence (if avail\u00adable). In addi\u00adtion, the appli\u00adca\u00adtion must state that the com\u00adplaint has been made to the client. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

Defen\u00addant<\/h2>

The defen\u00addant must be a con\u00adtract\u00ading author\u00adi\u00adty with\u00adin the mean\u00ading of Sec\u00adtion 98 GWB.<\/strong> Such con\u00adtract\u00ading author\u00adi\u00adties are pub\u00adlic con\u00adtract\u00ading author\u00adi\u00adties pur\u00adsuant to Sec\u00adtion 99 GWB, sec\u00adtor con\u00adtract\u00ading author\u00adi\u00adties pur\u00adsuant to Sec\u00adtion 100 GWB and con\u00adces\u00adsion award\u00ading author\u00adi\u00adties pur\u00adsuant to Sec\u00adtion 101 GWB.<\/p>

A con\u00adtract\u00ading author\u00adi\u00adty with\u00adin the mean\u00ading of Sec\u00adtion 99 GWB<\/strong> is an insti\u00adtu\u00adtion or body belong\u00ading to the pub\u00adlic sec\u00adtor, such as region\u00adal author\u00adi\u00adties (cities, munic\u00adi\u00adpal\u00adi\u00adties, fed\u00ader\u00adal states), their spe\u00adcial funds and oth\u00ader legal enti\u00adties, includ\u00ading those under pri\u00advate law, which per\u00adform non-com\u00admer\u00adcial tasks in the pub\u00adlic inter\u00adest.<\/p>

Sec\u00adtor con\u00adtract\u00ading enti\u00adty with\u00adin the mean\u00ading of Sec\u00adtion 100 (1) GWB <\/strong> are con\u00adtract\u00ading author\u00adi\u00adties or cer\u00adtain nat\u00adur\u00adal or legal per\u00adsons under pri\u00advate law that car\u00adry out sec\u00adtoral activ\u00adi\u00adties in the water, elec\u00adtric\u00adi\u00adty, gas and heat, trans\u00adport, ports and air\u00adports or fos\u00adsil fuels sec\u00adtors. (Sec\u00adtor activ\u00adi\u00adties specif\u00adi\u00adcal\u00adly in Sec\u00adtion 102 GWB)<\/p>

Con\u00adces\u00adsion grantor with\u00adin the mean\u00ading of Sec\u00adtion 101 (1) GWB <\/strong> are con\u00adtract\u00ading author\u00adi\u00adties that award a con\u00adces\u00adsion with\u00adin the mean\u00ading of Sec\u00adtion 105 I GWB. Con\u00adces\u00adsion providers are also sec\u00adtor con\u00adtract\u00ading author\u00adi\u00adties in the areas of elec\u00adtric\u00adi\u00adty, gas and heat, trans\u00adport, ports and air\u00adports or fos\u00adsil fuels that award such a con\u00adces\u00adsion.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

The con\u00adtract val\u00adue under pub\u00adlic pro\u00adcure\u00adment law must have reached the rel\u00ade\u00advant EU thresh\u00adold val\u00adue with\u00adin the mean\u00ading of Sec\u00adtion 106 GWB.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Bid\u00adders or can\u00addi\u00addates who have an inter\u00adest in the pub\u00adlic con\u00adtract or con\u00adces\u00adsion and assert a breach of pro\u00adcure\u00adment reg\u00adu\u00adla\u00adtions that infringes their own rights are enti\u00adtled to sub\u00admit an appli\u00adca\u00adtion. The bid\u00adder or appli\u00adcant must demon\u00adstrate that the infringe\u00adment has caused dam\u00adage or threat\u00adens to cause dam\u00adage. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

How\u00adev\u00ader, inter\u00adest may also exist if a bid is not sub\u00admit\u00adted. Impend\u00ading vio\u00adla\u00adtion of rights or dam\u00adage: <\/strong>It must at least appear pos\u00adsi\u00adble that the com\u00adpa\u00adny\u2019s rights under Sec\u00adtion 97 (6) GWB have been infringed as a result of non-com\u00adpli\u00adance with pro\u00adcure\u00adment reg\u00adu\u00adla\u00adtions. The dam\u00adage must relate to the bid\u00adder\u2019s or appli\u00adcan\u00adt\u2019s chances of being award\u00aded the con\u00adtract. The appli\u00adcant must plau\u00adsi\u00adbly demon\u00adstrate that the infringe\u00adment com\u00adplained of has a neg\u00ada\u00adtive impact on the con\u00adsid\u00ader\u00ada\u00adtion of its bid or appli\u00adca\u00adtion in the con\u00adtext of the award of the con\u00adtract. For this pur\u00adpose, it is suf\u00adfi\u00adcient that the occur\u00adrence of dam\u00adage can\u00adnot be ruled out from the out\u00adset. It fol\u00adlows that the bid\u00adder or appli\u00adcant must con\u00adclu\u00adsive\u00adly demon\u00adstrate that it at least has the pos\u00adsi\u00adbil\u00adi\u00adty<\/em> of being award\u00aded the con\u00adtract if the pro\u00adcure\u00adment reg\u00adu\u00adla\u00adtions are applied cor\u00adrect\u00adly. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

Oblig\u00ada\u00adtion to give notice of defects pur\u00adsuant to Sec\u00adtion 160 (3) No. 1\u20133 GWB: <\/strong> The bidder\/candidate must noti\u00adfy the con\u00adtract\u00ading author\u00adi\u00adty of the sus\u00adpect\u00aded infringe\u00adment pri\u00ador to the review pro\u00adce\u00addure. He must do so with\u00adin 10 days of becom\u00ading aware of the infringe\u00adment. If the breach is rec\u00adog\u00adniz\u00adable from the con\u00adtract notice or the ten\u00adder doc\u00adu\u00adments, it must be report\u00aded by the end of the dead\u00adline for sub\u00admit\u00adting a request to par\u00adtic\u00adi\u00adpate or sub\u00admit\u00adting a ten\u00adder. The exact require\u00adments are set out in Sec\u00adtion 160 (3) GWB and the rel\u00ade\u00advant case law. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

The pro\u00adcure\u00adment cham\u00adber either grants the appli\u00adca\u00adtion in full or in part and takes appro\u00adpri\u00adate mea\u00adsures to rem\u00ade\u00addy the infringe\u00adment (for exam\u00adple, the cham\u00adber can order the pro\u00adcure\u00adment pro\u00adce\u00addure to be restored to its pre\u00advi\u00adous state), or it rejects the appli\u00adca\u00adtion. An imme\u00addi\u00adate appeal may be lodged against the deci\u00adsion of the pro\u00adcure\u00adment cham\u00adber. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
