\nThe con\u00adtract\u00ading author\u00adi\u00adty shall con\u00adtin\u00adu\u00adous\u00adly doc\u00adu\u00adment the pro\u00adcure\u00adment pro\u00adce\u00addure in text form from the begin\u00adning, to the extent nec\u00ades\u00adsary to jus\u00adti\u00adfy mate\u00adr\u00adi\u00adal deci\u00adsions at each stage of the pro\u00adcure\u00adment pro\u00adce\u00addure.<\/strong>
\nThis means that he writes down his assess\u00adment of the pro\u00adcure\u00adment need, the type of pro\u00adce\u00addure and the gen\u00ader\u00adal con\u00addi\u00adtions (e.g. with\u00adout lot split\u00adting) before pub\u00adli\u00adca\u00adtion of the con\u00adtract notice.<\/strong>

An excep\u00adtion\u00adal case may be opened if eco\u00adnom\u00adic or tech\u00adni\u00adcal rea\u00adsons require that sev\u00ader\u00adal par\u00adtial or spe\u00adcial\u00adized lots be award\u00aded togeth\u00ader. After deter\u00admin\u00ading the sub\u00adject of the pro\u00adcure\u00adment, the con\u00adtract\u00ading author\u00adi\u00adty must, pur\u00adsuant to Sec\u00adtion 97 para. 4 GWB in a com\u00adpre\u00adhen\u00adsive weigh\u00ading of inter\u00adests with the fun\u00adda\u00admen\u00adtal require\u00adment of award\u00ading spe\u00adcial\u00adized lots. The required con\u00adsid\u00ader\u00ada\u00adtion and jus\u00adti\u00adfi\u00adca\u00adtion of the deci\u00adsion shall be doc\u00adu\u00adment\u00aded. This includes dis\u00adcussing the advan\u00adtages of award\u00ading con\u00adtracts in batch\u00ades and not just their dis\u00adad\u00advan\u00adtages.<\/strong>
\nIf the over\u00adall award is based on a lack of tech\u00adni\u00adcal com\u00adpat\u00adi\u00adbil\u00adi\u00adty among sev\u00ader\u00adal man\u00adu\u00adfac\u00adtur\u00aders, con\u00adcrete expla\u00adna\u00adtions of the alleged tech\u00adni\u00adcal com\u00adpat\u00adi\u00adbil\u00adi\u00adty con\u00adsid\u00ader\u00ada\u00adtions must be avail\u00adable in par\u00adtic\u00adu\u00adlar. If it is based on addi\u00adtion\u00adal per\u00adson\u00adnel expens\u00ades, these must be specif\u00adi\u00adcal\u00adly quan\u00adti\u00adfied and pre\u00adsent\u00aded in a com\u00adpre\u00adhen\u00adsi\u00adble man\u00adner.<\/strong> What is need\u00aded here is a care\u00adful analy\u00adsis of needs with a com\u00adpar\u00ada\u00adtive cal\u00adcu\u00adla\u00adtion show\u00ading what actu\u00adal expense will be incurred and what addi\u00adtion\u00adal expense will result from lot split\u00adting and what addi\u00adtion\u00adal expense is then con\u00adsid\u00adered unrea\u00adson\u00adable.
\nIf it is argued that the cus\u00adtomers of the con\u00adtract\u00ading author\u00adi\u00adty only accept a solu\u00adtion from a sin\u00adgle source, it must be con\u00adsid\u00adered whether the cus\u00adtomers in turn have alter\u00adna\u00adtive options, because as con\u00adtract\u00ading author\u00adi\u00adties they are also bound by the ARC.
\nIf the over\u00adall award is based on sev\u00ader\u00adal argu\u00adments, one of which can\u00adnot be ver\u00adi\u00adfied, it can\u00adnot be estab\u00adlished that the deci\u00adsion would have been tak\u00aden by the con\u00adtract\u00ading author\u00adi\u00adty in the same way even if this strand of rea\u00adsons had been omit\u00adted.<\/strong><\/p>\n
